WHAT IS COVERED. Coverage described in this Service Agreement will not replace or provide duplicative benefits during any active manufacturer’s warranty period. READ THESE SECTIONS CAREFULLY. ⯈ About Repairs: Parts used for repairs may be new, used, refurbished or non-original manufacturer parts that perform to the factory specifications of Your original Covered Product. ⯈ About Replacements: Reasonable efforts will be made to replace Your original Covered Product with the same product; however, there may be some cases where it is impossible to procure an exact match (for example, the manufacturer may have deemed the model or color obsolete). In such situations, We will provide You with a replacement that is at least of equal features and functionality, but it may be a different brand or color from Your original Covered Product. Additionally, please note that sometimes technological advances that are out of Our control may result in a replacement that has a lower selling price than Your original Covered Product, and this Agreement does not provide any reimbursement for such a cost difference. Also know that any/all parts, components, or whole items that We provide replacement for will automatically become Our property. ⯈ About Reimbursements: In the event We decide to provide You with reimbursement towards the replacement of the defective Product, such reimbursement may be in the form of a check, voucher or Retailer gift card/store credit and the value of such will in no event exceed the LIMIT OF LIABILITY of this Agreement.

WHAT IS COVERED. The Software Warranty only covers the most current General Availability (GA) version of the Software and the most current Early Adopter (EA) version of the Software. WHAT IS COVERED. Any Breakdown must be reported to Us within seven (7) days of occurrence. We will only repair or replace Your Covered Product due to the defects specifically listed for each product category below. Parts will be replaced at Our option with those of like kind and quality as determined by Us and may be new or remanufactured. If the Covered Product (1) cannot be repaired, (2) if the cost of the repair exceeds the original purchase price of the Covered Product, or (3) if the parts are no longer available or are discontinued by the manufacturer, the affected item will be replaced with a product of similar features as determined by Us, not to exceed the purchase price of the Covered Product, excluding sales tax, delivery and installation costs. WHAT IS COVERED. Xxxxxxx Hardscape, Ltd.’s (“Xxxxxxx”) Work. “Work” shall mean that certain work and those services further described between Xxxxxxx and Owner (the “Agreement”) and this Limited Warranty is an exhibit to such Agreement.

Provider will reimburse you for the repair or, if repair is not feasible, then for the replacement of, residential Electrical Products that fail due to an Electrical Surge during the term of this Agreement. “E lectrical Products” means consumer appliances, electronics, and electrical devices valued at $100 or greater, including window air conditioning units, stoves, ovens, refrigerators, clothes washers, clothes dryers, dishwashers, microwaves, televisions, DVD/Blu-ray players, game consoles, computers, laptops, tablets, printers, scanners, cameras, lights and smart hubs. “Electrical Surge” means an occurrence of a sudden and non-continuous increase or burst of electricity or electrical current, caused by natural or man-made events including lightning strikes and power returning after an outage, which can accelerate wear and tear and result in the failure of Electrical Products. This Agreement provides coverage only for Electrical Products which are owned by you or a member of your household and which are located within the perimeter of the main foundation or attached garage at the service address or account identified on the Declarations Page that fail due to the accelerated wear and tear of Electrical Surges. If the identified service address has multiple units or multiple accounts, a separate Agreement must be purchased for each individual unit or account. Repair or replacement costs, and diagnostic fees, are covered only up to the Per-Incident and Annual Limits specified on the Declarations Page, and subject to the exclusions described below. Any repair or replacement charges beyond the Per-Incident or Annual Limits are your responsibility. An “incident” means the particular Electrical Surge causing accelerated wear and tear that leads to a need for repair or replacement of Electrical Product(s). The “Annual Limit” specified on the Declarations Page is the aggregate limit on the amount that Provider will pay for any one or more incidents that occur within an Annual Term of this Agreement. An “Annual Term” of this Agreement means the initial twelve-month term of this Agreement, commencing on the Effective Date of this Agreement and any successive twelve-month renewal term under this Agreement.
