Voluntary Separation definition
Voluntary Separation means an employee whose employment has been terminated and whose position is filled by another employee who was about to be or has been given a lay-off notice, or who has been laid-off and is on the priority list as a result of a lay-off.
Voluntary Separation means the termination of a Covered Employee’s employment from a Covered Employer as a result of the Covered Employee voluntarily resigning at his/her own instance without having been requested to do so by the Covered Employer, excluding circumstances beyond a Covered Employee’s control, including, but not limited to, circumstances where the employer is responsible for the employee’s separation (e.g., the employer does not return the employee to his/her same position or reinstate the employee to a comparable position or fails to provide employee with lactation accommodations), or circumstances where the employee is needed to care for a seriously ill family member (e.g. the employee’s new child has a serious health condition requiring the employee’s full-time care).
Voluntary Separation means:
(i) an employee whose employment has been terminated and whose position is filled by another employee who was about to be or has been given a lay-off notice or who has been laid-off and is on the priority list as a result of a lay-off.
(ii) an employee whose position has been transferred to a new community and the employee chooses not to transfer with the position.
(iii) An employee who may be subject to lay-off because of the elimination of a position and chooses termination and the benefits under Article 32.08, in accordance with the Memorandum of Understanding – Voluntary Separation in Cases of Elimination of Position.

The College will have the discretion to participate in a Voluntary Separation Incentive Program or a Voluntary Retirement Incentive Program, if such programs are provided for in the operating budget.

More Definitions of Voluntary Separation
Voluntary Separation means the voluntary resignation by Employee from employment with the Company other than a voluntary resignation following either of the following two events:
(i) any future reduction in Employee's base salary; or
(ii) a future relocation of Employee's place of employment which results in an increase of twenty-five (25) miles or more in the distance from Employee's residence to Employee's place of employment.
Voluntary Separation means the separation of Executive’s employment hereunder that is effected by Executive for any reason, other than a Separation With Good Reason (it being understood that Executive may voluntarily resign his employment at any period after the Effective Date), by the Executive giving prior notice to the Corporation at least one hundred and eighty (180) days prior to the effective date of such separation.

Voluntary Separation means separation by mutual consent or acquiescence; but if respondent denies that the separation was voluntary then mutual consent or acquiescence must be established either by written agreement of the parties or by proof of institution by respondent of separate judicial proceedings premised upon respondent's consent to or acquiescence in the separation.
