Vested Participant definition

Vested Participant means a Participant who is no longer an Employee, but who is entitled to benefits in accordance with Article VI.

Vested Participant means, as of any specific date, a Participant who, as of such date, satisfies each eligibility requirement set forth in the first sentence of Section 3 of the Plan.

• Unless otherwise elected as provided below, a Vested Participant who dies before the Annuity Starting Date and who has a surviving Spouse shall have the Pre-Retirement Survivor Annuity paid to the surviving Spouse.

• In the event a Vested Participant separates from service prior to the beginning of the election period, the election period shall begin on the date of such separation from service.

• If a 0% Vested Participant's Account is entitled to an allocation of Employer contributions or Participant forfeitures for the Plan Year in which the Participant has a Severance from Employment, the Plan Administrator will apply the deemed cash-out rule as if the 0% Vested Participant received a Cash-Out Distribution on the first day of the first Plan Year beginning after his/her Severance from Employment.

• If a 0% Vested Participant's Account is not entitled to an allocation of Employer Contributions for the Plan Year in which the Participant has a Severance from Employment, the Plan Administrator will apply the deemed cash-out rule as if the 0% Vested Participant received a Cash-Out Distribution on the date of the Participant's Severance from Employment.

• Any other Vested Participant may elect to commence payment of his benefits on the first day of any month preceding his Normal Retirement Date and after his vested Termination Date as specified in the Adoption Agreement.

Vested Participant means a Participant who has satisfied the vesting requirements of the Qualified Salaried Plan.
