The price for a job or project ordered by the Owner under this proposed Contract shall be based on the Unit Price Book and Contractors Coefficient, and any non-prepriced items. Non-prepriced items shall not exceed ten percent (10%) of the Job Order unless specifically authorized by UTHealth. The Owner shall have the unconditional right to withdraw its Job Order at any time before or after the contractor has submitted its proposal for a Job Order. For a Job Order for a job or project under this proposed Contract to become effective, it must be (a) signed by the Owner and the Contractor, (b) a fixed price, lump sum contract, and (c) based on a Statement of Work which may be negotiated between the Owner and the Contractor.
