Undelivered definition

Undelivered means, with respect to a Contract and any date of determination, a Contract identified on the exception report attached to the Acknowledgment delivered by the Indenture Trustee under Section 6.01(k) of the Indenture on the Closing Date as a Contract as to which the Indenture Trustee (a) did not receive the related contract or promissory note as of the Closing Date and (b) has not received the related contract or promissory note and remitted payment for it to the Company pursuant to Section 6.12.
Undelivered means, with respect to any Deliverable Obligation, not Delivered.

  • Transit means the passage of a third country national or a stateless person through the territory of the Requested State while travelling from the Requesting State to the country of destination;

  • Nonconforming sign means a sign or sign structure, other than a nonstandard sign or a sign that is erected and maintained in a business area along a scenic byway prior to the designation as a scenic byway, that satisfies 1 of the following:

  • Shortage means that a grain dealer does not have a sufficient amount of farm produce by class and quality to cover the grain dealer's outstanding warehouse receipt obligations for that farm produce.

  • Scrap metal means ferrous or nonferrous metal, or items that contain ferrous or nonferrous metal, that are sold or offered for sale for the value of the ferrous or nonferrous metal they contain rather than their original intended use; ferrous or nonferrous metal removed from or obtained by cutting, demolishing, or disassembling a building, structure, or manufactured item; or other metal that cannot be used for its original intended purpose but can be processed for reuse in a mill, foundry, die caster, or other manufacturing facility.

  • Properly Shredded Garbage means the wastes from the preparation, cooking, and dispensing of food that have been shredded to such a degree that all particles will be carried freely under the flow conditions normally prevailing in public sewers, with no particle greater than one-half (1/2) inch (1.27 centimeters) in any dimension.

  • Household goods means personal effects and property used or to be used in a dwelling when a part of the equipment or supply of that dwelling. Household goods do not include property moving from a factory or store, unless the property was purchased by the householder with intent to use the property in his or her dwelling, the property is transported at the request of the householder, and the householder pays the carrier's transportation charges either directly or indirectly.

  • Customer Account means an account carried by a Participant on behalf of a Customer.

  • Asynchronous store and forward means the transmission of a patient's medical information from an originating site to the health care provider for telehealth at a distant site without the presence of the patient.

  • Cancellation means an end to the Contract affected pursuant to a right which the Contract creates due to a Breach.
