Unacceptable Product definition

Unacceptable Product means any one of the following:

Examples of Unacceptable Product in a sentence

  • Notwithstanding any other provision of this paragraph 2, the undersigned shall not be required to reimburse Buyer for Unacceptable Product if the unacceptability resulted solely from the gross negligence or willful misconduct in the handling of the product by Buyer or Buyer’s customer.

  • Payments to CARBO for, the Contract Manufacturing Price of Commercial Product, as well as any other payment due from PICONYX to CARBO pursuant to this Agreement, shall be made by PICONYX within thirty (30) days after the date of a valid invoice, except as to Unacceptable Product.

  • Unless any nonconformity is caused by (i) a negligent or wrongful act or omission by PICONYX or its agents, or (ii) the inability of the PICONYX Property to manufacture a Commercial Product, PICONYX’s sole and exclusive remedy for any Unacceptable Product delivered by CARBO to PICONYX is for CARBO to replace the Unacceptable Product with Product that meets the Product Specifications, including the cost of all Raw Materials needed to replace the Unacceptable Product.

  • PICONYX may reject any Commercial Product by promptly notifying CARBO in writing of PICONYX’s determination that such Commercial Product constitutes an Unacceptable Product.

  • The findings of such Third Party regarding whether the Product was an Unacceptable Product shall be binding upon CARBO and PICONYX.

  • SWD will undertake the duties set out in the General Obligations of SWD to the Operator.

  • Recyclable Product means the ability of a product and its packaging to be reused, reconditioned for use, or recycled through existing recycling collection programs.

  • House dust mite product means a product whose label, packaging, or accompanying literature states that the product is suitable for use against house dust mites, but does not indicate that the product is suitable for use against ants, cockroaches, or other household crawling arthropods.

  • Replacement Product means electric generating capacity, capacity-related benefits, environmental attributes, Energy or other electric products from a generation resource other than the Facility that are provided or delivered to replace or substitute for Contract Capacity or Storage Capacity (or any Capacity-Related Benefit, Environmental Attribute, Other Electric Product, Contract Energy, or Storage Energy associated therewith), in each case, in whole or in part, pursuant to Section 4.6.

  • Product means any deliverable under the Contract, which may include commodities, services, technology or software.

An Applicable Program includes any legislation or regulation concerned with renewable energy, oxides of nitrogen, sulfur, or carbon, with particulate matter, soot, or mercury, or implementing the UNFCCC or crediting “early action” with a view thereto, or laws or regulations involving or administered by an Administrator, or under any present or future domestic, international or foreign RECs, Products, Environmental Attributes or emissions trading program. Applicable Programs do not include legislation providing for production tax credits or other direct third-party subsidies for generation by a Renewable Energy Source.

  • Free product means a contaminant that is present as a non-aqueous phase liquid for chemicals whose melting point is less than 30° C (e.g., liquid not dissolved in water).

  • Aerosol product means a pressurized spray system that dispenses product ingredients by means of a propellant contained in a product or a product's container, or by means of a mechanically induced force. “Aerosol Product” does not include “Pump Spray.”

  • Edible cannabis product means cannabis product that is intended to be used, in whole or in part, for human consumption, including, but not limited to, chewing gum, but excluding products set forth in Division 15 (commencing with Section 32501) of the Food and Agricultural Code.   • Product Labeling means, with respect to a Licensed Product in a country or other jurisdiction in the Territory, (a) the Regulatory Authority-approved full prescribing information for such Licensed Product for such country or other jurisdiction, including any required patient information, and (b) all labels and other written, printed, or graphic matter upon a container, wrapper, or any package insert utilized with or for such Licensed Product in such country or other jurisdiction.

  • Drug Substance means an active ingredient that is intended to furnish pharmacological activity or other direct effect in the diagnosis, cure, mitigation, treatment, or prevention of disease or to affect the structure or any function of the human body, but does not include intermediates used in the synthesis of such ingredient.

  • Final Product means a product that is not used in producing other products and is built and intended for use outdoors, provided the final product has not deteriorated or has otherwise become a potential source of contaminants.
