• Notwithstanding anything contained herein, in providing services to the assisted Vessel, Portland Tugboat is relying upon the credit of the Vessel, and maintains its right to assert a lien against said Vessel for any amounts due for Tug Services rendered, including those referenced above.

• The provisions of this paragraph may not be changed or modified in any manner whatsoever except by written instrument signed by an officer of Portland Tugboat.

• In the event that full payment is not made when due, Portland Tugboat shall be entitled to recover all costs of collection including reasonable attorney's fees and court costs, and 1.5 % interest per month on all outstanding balances.

• You acknowledge and agree that we may access and Process Personal Data as necessary to provide the Service in accordance with the Agreement, and in particular that Personal Data will be transferred to and Processed by Tugboat Logic, Inc.

• In addition, Portland Tugboat shall not assume any liability and shall be held harmless for conducting such operations.

• The Contractor can use as a replacement any Tugboat that can satisfactorily perform the Work as specified.
