In the event either C-3 or C-4 becomes a Satellite Failure, or in the event more than one transponder on C-3 or C-4 becomes a Transponder Failure under circumstances which prevent all such Failed Transponders from being restored, Protection Transponders shall be assigned in accordance with Article ▇.▇.
If there is a Transponder Failure, owing to (i) a fault not attributable to the CUSTOMER, DOS shall use its reasonable endeavors to restore (which may or may not involve the activation of TWTA per Article 4 above) or substitute the Capacity as soon as reasonably practicable.
Any Transponder restoration shall be effected by SES Americom as soon as technically feasible but in any event in not more than one (1) hour after a Transponder is a Transponder Failure (provided that such one-hour obligation shall not commence until Customer has vacated use of the Transponder) and any Protection Transponder provided to Customer shall be deemed a Transponder Protected Transponder.
If no Replacement Transponder is available, GE Americom shall restore the Transponder Failure by using an unassigned or Preemptible Transponder on that Satellite, if available.
The transponder assignment will be changed only if the assigned Transponder becomes a Transponder Failure or to prevent interference by or to Client's operations.
