Trade Error definition

Trade Error means the Insured’s negligence in the clearance, settlement or execution of trades as specifically directed by a client.
Trade Error means any error of the Sub-Adviser in the communication or administration of trading and investment instructions in respect of the Allocated Portion. The parties mutually agree and acknowledge that the determination of what constitutes a Trade Error for purposes of this Agreement will be made by the Adviser and Sub-Adviser in good faith, and in consultation with the Trust or the Trustees as necessary, taking into account factors including but not limited to the investment policies, objectives and restrictions of the Fund, and the Investment Guidelines (as may be amended from time to time). Any losses to the Fund resulting from a Trade Error concerning a trade made by the Sub-Adviser for the Allocated Portion, which cannot be unwound or reimbursed by the broker or dealer, will be promptly reimbursed to the Fund by the Sub-Adviser, or by the Sub-Adviser and Adviser as apportioned among them by mutual agreement. However, to the extent that the Fund receives any payments from the broker, dealer or another third party for the same loss, the Fund will promptly reimburse the Sub-Adviser, or reimburse the Sub- Adviser and Adviser, their respective apportioned amounts paid.
Trade Error means any trade error and similar human error involving any transaction in any digital asset account directly or indirectly held by the Partnership and/or any Trading Subsidiary, including:

Examples of Trade Error in a sentence

  • It is acknowledged and agreed that any Trade Error that results in a gain to the Fund shall inure to the benefit of the Fund.

  • The Adviser agrees to provide prior written notice to the Subadviser of any material changes to the definition of Trade Error becoming effective with respect to the Designated Series unless, in the reasonable discretion of the Adviser, such change must become effective earlier due to any applicable law, rule, regulation or court order.

  • It is acknowledged and agreed that any Trade Error that results in a gain to the Designated Series shall inure to the benefit of the Designated Series.

  • Any gains that occur due to a Trade Error shall be retained by the Fund.


More Definitions of Trade Error

Trade Error means any trade error and similar human error involving any transaction in any Master Fund account, including: (i) the placement of orders (either purchases, sales, covers or shorts) in excess of the amount of securities the Master Fund intended to trade; (ii) the sale of a security when it should have been purchased; (iii) the purchase of a security when it should have been sold; (iv) the purchase or sale of the wrong security; (v) the purchase or sale of a security contrary to regulatory restrictions or Master Fund investment guidelines or restrictions; and (vi) incorrect allocations of securities.
Trade Error means any trade error and similar human error involving any transaction in any Partnership account, including: (i) the placement of orders (either purchases, sales, covers or shorts) in excess of the amount of securities the Partnership intended to trade; (ii) the sale of a security when it should have been purchased; (iii) the purchase of a security when it should have been sold; (iv) the purchase or sale of the wrong security; (v) the purchase or sale of a security contrary to regulatory restrictions or Partnership investment guidelines or restrictions; and (vi) incorrect allocations of securities.
Trade Error means any trade error and similar human error involving any transaction in any digital asset account directly or indirectly held by the Partnership and/or any Trading Subsidiary, including: (i) the placement of orders (either purchases or sales) in excess of, or less than, the amount of digital assets the account intended to trade; (ii) the sale of a digital asset when it should have been purchased; (iii) the purchase of a digital asset when it should have been sold; (iv) the purchase or sale of the wrong digital asset; (v) the purchase or sale of a digital asset contrary to regulatory restrictions or investment guidelines or restrictions of the account; (vi) incorrect allocations of trades between the account and any Other Account that does not trade pari passu with the account; (vii) keystroke errors that occur when entering trades into an electronic trading system; and (viii) typographical or drafting errors.
Trade Error means any trade error and similar human error involving any transaction in any Partnership account, including: (i) the placement of orders (either purchases or sales) in excess of the amount of Financial Instruments the Partnership intended to trade; (ii) the sale of a Financial Instrument when it should have been purchased; (iii) the purchase of a Financial Instrument when it should have been sold; (iv) the purchase or sale of the wrong Financial Instrument; (v) the purchase or sale of a Financial Instrument contrary to regulatory restrictions or Partnership investment guidelines or restrictions; and (vi) incorrect allocations of Financial Instruments.
Trade Error means an “Insured’s” failure to follow investment instructions from a client during the "Certificate Period" in connection with those "Professional Services" listed in Subsections 1.b. and 1.d. in the Professional Services Endorsement – Life Insurance Company Sponsored Insurance Agents Errors and Omissions Endorsement, when such “Trade Error” would be reasonably likely to result in a “Claim” as defined in Subsection

Related to Trade Error

  • NAV Error means an error in the computation of the net asset value for a Fund or class as more fully described in the NAV Error Policy.

  • Software Error means a reproducible defect or combination thereof in the Software that results in a failure of the Software when used in accordance with the Documentation. Software Errors do not include those errors caused by (a) Licensee’s negligence, (b) any unauthorized modification or alteration Licensee makes to the Software, (c) data that does not conform to Licensor’s specified data format, (d) operator error, or (e) use not conforming to the Licensor’s supported technical environment specified in the Documentation.

  • Medication error means any preventable event that may cause or lead to inappropriate medication use or patient harm, while the medication is in the control of the health care professional, patient, or consumer. Such events may be related to professional practice, health care products, procedures, and systems including, but not limited to: prescribing; order communication; product labeling, packaging and nomenclature; compounding; dispensing; distribution; administration; education; monitoring; and use.

  • Manifest Error means any error that we reasonably believe to be obvious or palpable, including without limitation, offers to execute Transactions for exaggerated volumes of Underlying Assets or at manifestly incorrect market price quotes or prices at a clear loss.
