Top Heavy Plan Year definition

Top Heavy Plan Year means a Plan Year during which the Plan is a Top Heavy Plan.
Top Heavy Plan Year means that, for a particular Plan Year commencing after December 31, 1983, the Plan is a Top Heavy Plan.

  • Subject to Section 3.14 of the Basic Plan, a Top Heavy Allocation will be made in each Top Heavy Plan Year to each Participant who is employed on the last day of the Plan Year < x and is a Non-Key Employee >.

Top Heavy Plan Year means that, for a particular Plan Year, the Plan is a Top Heavy Plan.
Top Heavy Plan Year means a Plan Year if the sum of the account balances of all key employees under the Plan and each other defined contribution plan (as of the applicable determination date of each such Plan) which is aggregated with the Plan, plus the sum of the present values of the total accrued benefits of all key employees under each defined benefit plan (as of the applicable determination date of each such plan) which is aggregated with the Plan exceeds 60 percent of the sum of such amounts for all Employees (including, for purposes of this paragraph (b), any person employed by the Corporation, an Affiliated Corporation or a Subsidiary) and former Employees (other than former key employees, but including Beneficiaries of former Employees) under the Plan and all such plans. For purposes of these determinations:
Top Heavy Plan Year means a Plan Year if any of the following conditions exist:
Top Heavy Plan Year means any Plan Year in which the Plan is a Top-Heavy Plan.
Top Heavy Plan Year means, for Plan Years beginning after December 31, 2001, a Plan Year during which the Plan is a Top Heavy Plan.
