  • Any such policy shall be between the Merchant and the User and the provision of the TNGD Mobile Payment Service and the Merchant’s obligation to be liable for the MDR (and other TNGD Fees, if applicable) shall not in any way be contingent upon such policy or other business practices of the Merchant.

  • For the avoidance of doubt TNGD shall not be liable for any cost, damages and/or liabilities incurred by the Merchant pursuant to any third party contracts entered into by the Merchant on or before the termination date in relation to the provision of the Services and such termination of convenience.

  • TNGD reserves the right to refuse to honour payment requests that TNGD believes or suspects are fraudulent or erroneous.

  • The Merchant shall make payments to TNGD free and clear of, and without reduction for any withholding or other taxes.
