If the Land Court orders a person to pay the attending party’s costs, the Land Court must decide the amount of the costs of attending.
However, the Land Court must not order a person to pay costs if the Land Court is satisfied the person had a reasonable excuse for not attending the conference.
In addition, the Land Court may extend the period for filing the notice of appeal.
Subsection (4) applies subject to section 338 and any decision of the Land Court under section 340 relating to the decision to refuse.
At a hearing pursuant to subsection (1) the Land Court shall take such evidence, shall hear such persons and inform itself in such manner as it considers appropriate in order to determine the relative merits of the application, objections and other matters (if any) and shall not be bound by any rule or practice as to evidence.

No work shall be undertaken until the Order has become final and then has been recorded in the Registry of Deeds or the Land Court for the district in which the land is located, within the chain of title of the affected property.
The Minister may require at any time the Land Court to advise the reasons why a hearing under this section has not been finalised.
If the Land Court fixes a date for the hearing and all properly made objections are withdrawn before the hearing starts, the Land Court may remit the matter to the mining registrar.
Nothing in subsection (1) shall prevent the question of compensation being determined by the Land Court pursuant to section 85.
