Test Software definition

Test Software means an instance of Jamf’s generally available Software provided to Customer On-Premise, as Hosted Services or for deployment on Devices for a limited term either for trial, evaluation or similar purposes. Test Software does not include Software versions that Jamf has not yet widely released, such as beta, preview, prototype or release candidate Software. Use of beta, preview or release candidate versions of the Software is governed by a separate agreement.
Test Software shall have the meaning set forth in Section 7.1.

Examples of Test Software in a sentence

  • Any information about the Test Software gathered from its access or use shall be used solely by Company for the test/evaluation and such information shall not be provided to any third party.

  • Sections 2.1, 2.2, and 2.5 of this Agreement do not apply to Test Software, but Sections 2.3, 2.4, and 2.6 do apply to Test Software.

  • During the Test Period, Company may be able to receive web or email based technical support in the country where Company is located, but otherwise support is not generally available for Test Software or Appliances.

  • Accordingly, Evaluator agrees not to make any commercial use of Confidential and Proprietary Information, and Evaluator shall not translate, copy, disassemble, reverse engineer, or decompile any Test Software, nor shall Evaluator make copies or translations of any Documentation.

  • Subject to the terms and provisions set forth, Evaluator is willing to accept delivery of the Test Software for the purpose of using and evaluating the same.

  • Evaluator further acknowledges that use of the Test Software may involve the transmission, upload, download, translation or transfer of its data to a server or computer platform outside of Evaluator’s control, and some errors in the data may occur while transferring, transmitting or translating data while using the Test Software.

  • The Test Software is “in use” on a computer when it is loaded into temporary memory (i.e., RAM) or installed into permanent memory (e.g. hard disk, CD-ROM or other storage device) of that computer.

  • You represent and warrant that will not access or use the Software, Test Software or Services in any United States-embargoed country or in breach of United States or other applicable export laws or regulations.

  • Test Software may only be used for the term and purpose authorized by Jamf.

  • Except for the licenses expressly granted by RFM to ST pursuant to Article 4, RFM and/or its licensors shall own all right, title and interest in and to the Evaluation Circuit Design, Evaluation Software, Manufacturing Test Software, Specifications, IC Design, IC Design File and Manufacturing Test Circuit Design (“RFM Owned Materials”), including any Intellectual Property Rights therein.
