Tenant’s Operating Share definition

Tenant’s Operating Share shall have the meaning ascribed to it be in Article 1 above.
Tenant’s Operating Share shall have the meaning ascribed to such term in Section 3.01(i);
Tenant’s Operating Share means % (which percentage may be adjusted in accordance with the provisions of Section 3.03(a) hereof), which has been calculated as a fraction, expressed as a percentage, the numerator of which is the rentable area of the Premises, which Landlord and Tenant agree is rentable square feet, and the denominator of which is the rentable area of the FC Office Units, which Landlord and Tenant agree is rentable square feet.

Examples of Tenant’s Operating Share in a sentence

  • Each party shall file and serve on all parties, within 14 days after being served, its agreement, objection, or nonobjection to the settlement agreement.

  • Upon thirty (30) days written notice from Landlord, the monthly installment of Tenant’s Operating Share may be adjusted a maximum of once per Operating Year to one-twelfth (1/12) of Tenant’s Operating Share of the actual Common Area Operating Charges incurred by Landlord during the preceding Operating Year.

  • Commencing on the Rent Commencement Date, Tenant shall pay as Additional Rent on the first day of each month during the Term by ACH wire transfer an amount equal to one-twelfth (1/12) of Landlord’s good faith estimate of Tenant’s Operating Share of Common Area Operating Charges for each Operating Year.

  • As Additional Rent, Tenant shall pay Tenant’s Operating Share of all Common Area Operating Charges.

  • No activities may be held which damages, modifies or otherwise harms the landscaping of the University grounds unless approved in writing by the Associate Vice Chancellor for Facilities Management or his/her designee prior to the start of the activity.


More Definitions of Tenant’s Operating Share

Tenant’s Operating Share means 2.88%, as the same may be increased or decreased in accordance with the terms of this Lease. The parties hereto agree that the rentable square foot area of the Premises shall be deemed to be, as of the date hereof, 32,727 rentable square feet and the rentable square foot area of the Building (less the retail component) shall be deemed to be 1,174,188 rentable square feet. Tenant’s Operating Share has been determined and/or redetermined by dividing the rentable square foot area of the Premises by the rentable square foot area of the Building (less the retail component).
Tenant’s Operating Share shall, for the 7th Floor Premises only, mean 5.02%, for so long as Landlord shall own the entire Building. If a portion or portions of the Building (but not the entire Building) shall be sold, transferred or conveyed, then Tenant’s Operating Share shall be changed to that percentage which shall be equal to a fraction, the numerator of which shall be the Rentable Square Feet, and the denominator of which shall be the aggregate rentable square feet of office space in that portion of the Building owned by Landlord at such time (and from time to time), as determined by a reputable, independent architect engaged by Landlord.
Tenant’s Operating Share for the Above-Grade Premises as of the date hereof shall mean 14.302%.
Tenant’s Operating Share means 5.24%;
Tenant’s Operating Share means 21.6978%, for so long as Landlord shall own all of the 7-21 Condominium. If a portion or portions of the 7-21 Condominium (but not all of the 7-21 Condominium) shall be sold, transferred or conveyed, or if Landlord shall enlarge the rentable area of the 7-21 Condominium by acquisition, construction of additional rentable area on the Land or in the Building, or by any other means, then Tenant’s Operating Share shall be changed to that percentage which shall be equal to a fraction, the numerator of which shall be the Rentable Square Feet, and the denominator of which shall be the aggregate rentable square feet of space in that portion of the 7-21 Condominium owned by Landlord at such time (and from time to time) including such additional rentable area, as reasonably determined by Landlord’s architect (provided that all such determinations shall be made in a manner consistent with the square footages and percentage shares applicable to the 7-21 Condominium and the Demised Premises on the date hereof).
Tenant’s Operating Share means, with respect to each item of Operating Expenses, Tenant’s allocable share of such item, determined in accordance with the methodology set forth in Exhibit R (“Cost Allocation Methodology”). References to Tenant 1 in Exhibit R shall be deemed to refer to Tenant. With respect to any Operating Expenses or other costs set forth on Exhibit R or otherwise in this Lease as being allocated by direct consumption or meters, Exhibit NN (“Metering Schedule”) hereto sets forth a description of all meters installed or to be installed in order to measure such consumption, and indicates whether Landlord or Tenant is responsible for the repair, maintenance and/or replacement of such meters. If any changes are made to the services provided to tenants or to the operation of the Building, any new categories of Operating Expenses shall be allocated in a fair and equitable manner, consistent with the concepts underlying the allocations in Exhibit R to the extent applicable. Any dispute with respect to the allocation of such new categories shall be resolved by arbitration in accordance with Section 8.09.
Tenant’s Operating Share means 40.85%, which is calculated by dividing (i) the then total rentable square footage of the Premises by (ii) the then total rentable square footage of the Building (excluding retail space, below grade space and any parking space in the Building). Tenant’s Operating Share shall not be increased or decreased during the Term, other than to reflect the incorporation of additional space into the Premises or the Building, or the removal of any space from the Premises or the removal of any space in the Building that is no longer available for leasing on account of such space being utilized for base building or other mechanical uses, pursuant to any exercise of any of Landlord’s or Tenant’s rights expressly provided herein.
