In addition, you acknowledge and agree that (1) prior to a Qualifying Entity’s inclusion in your Deployment Right, you must execute with Oracle an amendment to this ordering document pursuant to which the Qualifying Entity’s Existing Technical Support Fees will be added to the Total Support Stream and (2) such Existing Technical Support Fees must be maintained as part of the Total Support Stream in order for you to maintain your Deployment Right.
Any Software Releases supplied by Supplier to OEM hereunder shall be used by OEM only to update licenses for Software obtained by OEM from Supplier under this Exhibit A and for which OEM has paid Supplier the applicable Supplier Technical Support Fees.

Additionally, OEM shall indicate in each Monthly Report for each applicable End User whether or not OEM elects to renew Technical Support with respect to Software for which the Technical Support period expires during the following month (for further detail, see Section 9.6 below), and if OEM elects to renew such Technical Support, applicable Technical Support Fees.
After December 31, 2000 and at Customer's option and request as set forth herein such Operational Software shall only be subject to annual Software Updates and/or Technical Support Fees under the Agreement, including Customer's right to change Technical Support Services upgrades to different Support levels or to change the number of Technical Contacts, as described on Schedule 1.
Following the second anniversary of the Effective Date, Nuance shall have sole discretion and authority to change the pricing for Software and Technical Support Services by providing OEM with thirty (30) days’ advance notice; provided, however, that Nuance shall provide to OEM ninety (90) days’ advance notice prior to a change in the price of Technical Support Fees.
If neither of the actions specified for Interwoven in the preceding sentence is commercially feasible, then as a last resort, Interwoven shall accept return of such Software and refund to Customer all Fees paid by Customer for such Software, plus any unused Software Update and/or Technical Support Fees paid for the Software.
