TDM Materials definition

TDM Materials means the materials, data and information created for or during TDM based on the Licensed Materials.
TDM Materials means the following, to the extent indicated on Schedule A or the applicable Invoice, and for such period indicated on the applicable Invoice: • Journal of Clinical Oncology XML files for Text and Data Mining, and • ASCO Meeting Abstracts XML files for Text and Data Mining (expedited delivery)

Examples of TDM Materials in a sentence

  • With respect to ASCO Meeting Abstracts XML content, within two (2) business days of the TDM Materials being published online.

  • Notwithstanding the foregoing, Licensee is expressly prohibited from “scraping” or “crawling” or conducting similar activities on websites owned or operated by ASCO, and Licensee and its Authorized Users may not transfer, sell, distribute, or otherwise convey any of the TDM Materials or the results of text or data mining the TDM Materials to third parties.

  • XML files of the TDM Materials will be delivered by Publisher or its designee via FTP on the following schedule: With respect to Journal of Clinical Oncology XML content, within five (5) business days of the TDM Materials being published online.

  • Licensee shall have the right to use automated programs or devices to continuously and automatically extract and index information from XML files prepared and delivered by ASCO or its designee relating to the TDM Materials solely for Licensee’s internal, non-commercial use.

  • Removal of locally-loaded copies of Licensed Materials and/or TDM Materials: Upon termination of the Text and Data Mining License under Section 4.1 above or upon expiration or termination for any reason of the rights granted under the License Agreement, Member shall procure the destruction of any copies of the Licensed Materials and/or TDM Materials which may be locally loaded.

  • Without limiting the foregoing, Licensee and its Authorized Users may not (i) create derivative products or services that would directly compete with Licensor or Licensor’s Affiliates products or services, or otherwise commercially use or allow commercial use of the TDM Output (ii) allow a third party to access or use any TDM Materials, (iii) perform TDM for a third party, or (iv) store, or permit storage of, Content or TDM Materials on any server other than an InternalServer.

  • Without limiting the foregoing, Member and its Authorized Users may not (i) create derivative products or services that would compete with or negatively affect Licensor or Licensor’s affiliates products or services, or otherwise commercially use or allow commercial use of the TDM Output, (ii) allow a third party to access or use any TDM Materials, (iii) perform TDM for a third party, or (iv) store, or permit storage of, Licensed Materials or TDM Materials on any server other than an Internal Server.

Related to TDM Materials

  • Custom Materials means Materials developed by the Supplier at the Procuring Entity's expense under the Contract and identified as such in Appendix 5 of the Contract Agreement and such other Materials as the parties may agree in writing to be Custom Materials. Custom Materials includes Materials created from Standard Materials.

  • Program Materials means the documents and information provided by the Program Administrator specifying the qualifying EEMs, technology requirements, costs and other Program requirements, which include, without limitation, program guidelines and requirements, application forms and approval letters.

  • IP Materials has the meaning given to it in clause E8.1 (Intellectual Property Rights).

  • SAP Materials means any software, programs, tools, systems, data, or other materials made available by SAP or any other member of the SAP Group to Partner or to an End User (either directly or indirectly via Partner) prior to or in the course of the performance under any part of this Agreement including, but not limited to, the other SAP Products.

  • Supplier Materials has the meaning set out in clause 8.1(g);

  • Cloud Materials means any materials provided or developed by SAP (independently or with Provider’s cooperation) in the course of performance under the Agreement, including in the delivery of any support or Consulting Services to Provider or its Customers. Cloud Materials do not include any Customer Data, Provider Confidential Information, or the SAP Cloud Service.

  • Developed Materials means Materials created, made, or developed by Contractor or Subcontractors, either solely or jointly with the Judicial Branch Entities or JBE Contractors, in the course of providing the Work under this Agreement, and all Intellectual Property Rights therein and thereto, including, without limitation, (i) all work-in-process, data or information, (ii) all modifications, enhancements and derivative works made to Contractor Materials, and (iii) all Deliverables; provided, however, that Developed Materials do not include Contractor Materials.

  • Study Materials means all the materials and information created for the Study, or required to be submitted to the Sponsor including all data, results, Biological Samples, Case Report Forms (or their equivalent) in whatever form held, conclusions, discoveries, inventions, know-how and the like, whether patentable or not, relating to the Study, which are discovered or developed as a result of the Study, but excluding the Institution’s ordinary patient records.

  • Customer Materials any materials, data, information, software, equipment or other resources owned by or licensed to You and made available to Us pursuant to facilitating Your use of the Services, including Customer Data.

  • Third Party Materials means materials and information, in any form or medium, including any software, documents, data, content, specifications, products, equipment or components of or relating to the Services that are not proprietary to NCIT.

  • Licensed Materials means any materials that Executive utilizes for the benefit of the Company (or any Subsidiary thereof), or delivers to the Company or the Company’s Customers, which (a) do not constitute Work Product, (b) are created by Executive or of which Executive is otherwise in lawful possession and (c) Executive may lawfully utilize for the benefit of, or distribute to, the Company or the Company’s Customers.

  • Client Materials means the CLIENT Development Materials and the CLIENT Production Materials.

  • Contractor Materials means Materials owned or developed prior to the provision of the Work, or developed by Contractor independently from the provision of the Work and without use of the Court Materials or Confidential Information.

  • Biological Materials means certain tangible biological materials that are necessary for the effective exercise of the Patent Rights, which materials are described on Exhibit A, as well as tangible materials that are routinely produced through use of the original materials, including, for example, any progeny derived from a cell line, monoclonal antibodies produced by hybridoma cells, DNA or RNA replicated from isolated DNA or RNA, recombinant proteins produced through use of isolated DNA or RNA, and substances routinely purified from a source material included in the original materials (such as recombinant proteins isolated from a cell extract or supernatant by non-proprietary affinity purification methods). These Biological Materials shall be listed on Exhibit A, which will be periodically amended to include any additional Biological Materials that Medical School may furnish to Company.

  • Manufacturing Materials means parts, tools, dies, jigs, fixtures, plans, drawings, and information produced or acquired, or rights acquired, specifically to fulfill obligations set forth herein.

  • GOODS / MATERIALS means any of the articles, materials, machinery, equipments, supplies, drawing, data and other property and all services including but not limited to design, delivery, installation, inspection, testing and commissioning specified or required to complete the order.

  • Input Material means all documents, information, representations, statements and materials provided by Customer or a third party on behalf of Customer, relating to the Services, including computer programs, data, logos, reports and specifications and inventories.

  • Proprietary Materials means any tangible chemical, biological or physical research materials that are furnished by or on behalf of one Party to the other Party in connection with this Agreement, regardless of whether such materials are specifically designated as proprietary by the transferring Party.

  • Background Material means any pre-existing works in which the Intellectual Property Rights are owned by either Party, which have been prepared by that Party outside the scope of this Agreement or which were licensed from a third party by that Party.”

  • Standard Materials means all Materials not specified as Custom Materials.

  • Licensed Material means the artistic or literary work, database, or other material to which the Licensor applied this Public License.

  • Training Materials means any and all materials, documentation, notebooks, forms, diagrams, manuals and other written materials and tangible objects, describing how to maintain the Facilities, including any corrections, improvements and enhancements thereto to the Bloom Systems which are delivered by Operator to Owner, but excluding any data and reports delivered to Owner.

  • Project Materials means any and all works of authorship, artistic, literary and other works, inventions and materials designed, created, developed, written or prepared by the Supplier (or the Supplier's Personnel) in the course of providing the Services, whether individually, collectively or jointly with the Purchaser and on whatever media;

  • Third Party Material means software, software development tools, methodologies, ideas, methods, processes, concepts and techniques owned by, or licensed to a third party and used by the Service Provider in the performance of the Services;

  • Printed Materials means all artwork and mechanicals set forth on the disc label of the PlayStation Disc relating to any of the Licensed Products and on or inside any Packaging for the Licensed Product, and all instructional manuals, liners, inserts, trade dress and other user information to be inserted into the Packaging.

  • Promotional Materials means all written, printed, graphic, electronic, audio or video presentations of information, including journal advertisements, sales visual aids, formulary binders, reprints, direct mail, direct-to-consumer advertising, disease awareness materials, internet postings, broadcast advertisements and sales reminder aides (for example, note pads, pens and other such items, if appropriate) intended for use or used by or on behalf of a Party, its Affiliates or its sublicensees in connection with the Commercialization of a Product in the Territory.
