Supplier’s Responsibilities. The Supplier shall notify the Company within twenty-four (24) hours in writing if its license to act as a Supplier is acted upon by PURA in such a way that it materially affects Supplier’s performance under this Agreement, including but not limited to, suspension, revocation, modification, or non-renewal. If the Company is notified by ISO-NE that a Supplier Load Asset has been suspended or terminated, the Company shall transfer all of the Supplier’s customers currently served Generation Service by that Supplier to the Company’s applicable Generation Service. This change shall be effective as of the next calendar day following the ISO-NE suspension or termination. Any costs, fines or penalties incurred by the Company as a result of reporting Load to ISO-NE caused by erroneous data obtained from the Supplier shall be the sole responsibility of the Supplier. The Supplier’s failure to pay all such costs, fines or penalties to the Company is a material breach of this Agreement and may result in termination of this Agreement, which termination shall not release the Supplier of its obligation to pay the Company for the same.
