On the date of this Agreement, the Borrower makes the Repeating Representations of the Original Facility Agreement, by reference to the facts and circumstances then existing, but as if references in the Repeating Representations of the Original Facility Agreement to “the Transaction Documents” includes this Agreement, the Amended Facility Agreement and each Supplemental Security Document.
The Borrower shall pay all present and future stamp and other like duties and taxes and all notarial, registration, recording and other like fees which may be payable in respect of this Supplemental Agreement or any Supplemental Security Document and shall indemnify each Finance Party against all liabilities, costs and expenses which may result from any default in paying such duties, taxes or fees.
