SUMF Item or “Item of SUMF” means any part of SUMF;

  • Except as otherwise provided in Schedule 2, the Purchaser shall purchase the amounts of each SUMF Item up to its Firm Capacity Reservation until termination of the supply of such SUMF Item in accordance with the provisions of this Agreement or the relevant Schedule.

  • EXECUTION COPY Notwithstanding the foregoing, the Purchaser has the right, provided there is no unreasonable disruption to any other of the Supplier’s operations, to obtain from other sources, including in-house production by the Purchaser, such new or additional requirements of the relevant SUMF Item as the requested project was to cover.

  • Notwithstanding the other provisions of this Article 10.8, the costs associated with the physical disconnection of all SUMF Items at the termination of this Agreement under Article 10.2 (C) or 10.5 (D) or upon termination of the supply of an individual SUMF Item under Article 10.6 (E) shall be paid one half by the Purchaser and one half by the Supplier.

  • Upon the termination of the supply of a SUMF Item to a Plant, the Purchaser shall physically disconnect from that SUMF Item's delivery system to the Plant in the time and manner instructed by the Supplier.

  • Notwithstanding anything to the contrary herein, in the event that (i) Delek Marketing uses the Relevant Assets to provide services to third parties, (ii) Delek Marketing’s provision of such third-party services results in a material increase of any SUMF Item required by Delek Marketing, and (iii) provision of such SUMF Items is available to Delek Marketing from third-party vendors on commercially reasonable terms, then Delek Refining may decline to provide such increased and additional SUMF Item.

  • Except as otherwise provided in this Agreement, the Purchaser may purchase the amounts of each SUMF Item up to its Firm Capacity Reservation until termination of the supply of such SUMF Item in accordance with the provisions of this Agreement or the relevant Schedule.

  • The Annual Service Fee with respect to increased quantities of any SUMF Item requested by Delek Marketing may be increased in accordance with Article 4 of this Agreement.

  • Contract Item or “Contract Items” means the list of items identified in Section

  • End item means the final production product when assembled or completed and ready for delivery under a line item of this contract.

  • Disputed Item has the meaning set forth in Section 1.3(c).

  • Central item means any item which is in italics in this Collective Agreement.

  • Commercial Item means a commercial item as defined in FAR 2.101.

  • Line Item means a field of information (or a combination of fields of information) to be entered in a Settlement Schedule by any Participating Subscriber in relation to a Conveyancing Transaction.

  • Recyclable material means a material generated by the entity's operations, including aluminum, steel containers, aseptic packag- ing and polycoated paperboard cartons, high-grade office paper, and corrugated cardboard.

  • Raw Materials means all raw materials, supplies, components and packaging necessary to manufacture and ship the Product in accordance with the Specifications, as provided in Exhibit A, but not including the API.

  • Procurement item means an item of personal property, a technology, a service, or a construction project.

  • Recyclable Materials means materials that are separated from mixed municipal solid waste for the purpose of recycling or composting, including paper, glass, plastics, metals, automobile oil, batteries, source-separated compostable materials, and sole source food waste streams that are managed through biodegradative processes. Refuse-derived fuel or other material that is destroyed by incineration is not a recyclable material. (Minn. Stat. § 115A.03, Subd. 25a)

  • Excess Concentration means the sum of the following amounts, without duplication:

  • Packet Loss means the difference between the number of service frames transmitted at the ingress UNI and the total number of service frames received at the egress UNI. Packet Loss may also be referred to as Frame Loss.

  • Nonconforming structure means a structure the size, dimension or location of which was lawful prior to the adoption, revision or amendment of a zoning ordinance, but which fails to conform to the requirements of the zoning district in which it is located by reasons of such adoption, revision or amendment.
