If the Successful Security Incident constitutes a Breach, the parties will proceed as required under this Agreement as to a Breach.
Successful Security Incidents will be reported to Covered Entity within two (2) business days of the date the Successful Security Incident is, or in the exercise of reasonable efforts should have been known, to Business Associate.
For Successful Security Incidents, Doctor shall give notice to CCMI not more than five (5) days after Doctor learns of the Successful Security Incident.
Business Associate shall report to Covered Entity any of the following events within two (2) business days of becoming aware of the occurrence of the event: Any Use or Disclosure of PHI not authorized by this Addendum; Any Successful Security Incident; and Any acquisition, access, Use or Disclosure of Unsecured PHI in a manner not permitted by the HIPAA Privacy Rule.
Subcontractor must report to the Attorney General any Use or Disclosure of PHI not provided for in this Agreement, any Successful Security Incident involving ePHI, and any Breach of Unsecured PHI as required by 45 C.F.R. §164.410.
