notice of substantial completion shall be subject to confirmation by Tenant (which confirmation or objection, if Tenant does not agree that Substantial Completion of Landlord\u2019s Work or any applicable portion thereof has occurred, shall be given (if at all) as promptly as possible and no more than five (5) business days after T\u2587\u2587\u2587\u2587\u2587\u2019s receipt of Landlord\u2019s notification and provided Landlord has afforded Tenant access to the Premises as provided in Section 4.9, and which confirmation (if any) shall specify any good faith objections and/or Tenant\u2019s determination that Substantial Completion of Landlord\u2019s Work (or applicable portions thereof) has not occurred). The failure of Tenant to confirm L\u2587\u2587\u2587\u2587\u2587\u2587\u2587\u2019s notification of Substantial Completion of Landlord\u2019s Work as set forth herein or to object in writing thereto within such five (5) business day period shall be deemed a confirmation of such notification. If Tenant objects to any matters set forth in Landlord\u2019s notice of Substantial Completion of Landlord\u2019s Work and notifies Landlord thereof within five (5) business days following receipt of the notice and the parties are unable to resolve the dispute within ten (10) days of Tenant\u2019s notice of objection, either party may elect to refer the dispute to arbitration in accordance with the provisions of Section 29.5 below. \u2587\u2587\u2587\u2587\u2587\u2587\u2019s receipt of Landlord\u2019s notification, and which confirmation (if any) shall specify any good faith objections and/or Tenant\u2019s architect\u2019s determination that Substantial Completion of Landlord\u2019s TI Work (or applicable portions thereof) has not occurred). If Landlord shall provide only a temporary and not a permanent certificate of occupancy then Landlord\u2019s notice of Substantial Completion will include Landlord\u2019s covenant to complete all of Landlord\u2019s TI Work and Landlord\u2019s Base Building Work required for obtaining a permanent certificate of occupancy. The failure of \u2587\u2587\u2587\u2587\u2587\u2587\u2019s architect to confirm \u2587\u2587\u2587\u2587\u2587\u2587\u2587\u2587\u2019s notification of Substantial Completion of Landlord\u2019s TI Work as set forth herein or to object in writing thereto within such three (3) business day period shall be deemed a confirmation that Substantial Completion has occurred.
