Sublicensed Product definition

Sublicensed Product means that certain buprenorphine subdermal implant licensed by Braeburn and known as of the Effective Date as Probuphine for use in the Field, including all Improvements thereto.

Sublicensed Product means any Licensed Product that is developed, made, used, Sold, offered for Sale or imported by or on behalf of a Sublicensee, whether Sold separately or as part of a Combination Product.

Sublicensed Product means, with respect to a particular sublicense hereunder, a Licensed Product covered by the grant of rights included in such sublicense, including with respect to the field and scope of such sublicense.

• Knight agrees, at the request of Braeburn, to execute any and all proper and reasonable documents appropriate to assist Braeburn in obtaining and maintaining Braeburn’s rights in and to the Braeburn Marks and Sublicensed Product Trademarks.

• Braeburn and Knight shall cooperate with each other and use Commercially Reasonable Efforts to protect the Braeburn Marks and Sublicensed Product Trademarks from infringement by Third Parties.

Sublicensed Product means any product, composition of matter, system or apparatus which, but for this Agreement, would otherwise infringe a valid claim of an unexpired patent included in the Sublicensed Patent Rights. * – Confidential Treatment Requested

Sublicensed Product means all products for therapeutic or diagnostic uses of the compound [B]-L-FD4C that may derive or result from the manufacture and production or use of one or more claims of the Sublicensed Patents or incorporate Sublicensed Technology, wherever sold.

Notwithstanding the foregoing, a Sublicensed Product may additionally contain a carrier or suspending agent of any composition including polymers (such as hyaluronic acid and/or carboxymethylcellulose) and materials which may form non-spherical solids.

Sublicensed Product means any product, the manufacture, use or sale of which would, but for the rights granted to Elan hereunder, infringe a valid claim of a patent within the Patent Rights in the country in which such activity occurs.
