Subject Proceedings definition

Subject Proceedings has the meaning assigned to such term in Section 6.5(f).
Subject Proceedings means, collectively, the following litigation and arbitration proceedings:

Examples of Subject Proceedings in a sentence

  • Any party who retains an expert to provide evidence or a report for the purposes of Subject Proceedings in the Tribunal must bring to the expert’s attention the contents of this Procedural Direction, including the experts’ code of conduct.

  • Nothing herein contained shall limit the right of any of the Underwriters to bring Subject Proceedings in any other court of competent jurisdiction.

  • The Company has not, and no Subsidiary of the Company has, entered into or accepted, and neither the Company nor any Subsidiary of the Company has authorized any of its representatives to enter into or accept, any settlement or agreement related to the Subject Proceedings, with any court, party to the Subject Proceedings, insurer or otherwise, other than the settlement with the parties to the Subject Proceedings pursuant to the Securities MOU and the Derivative MOU.

  • Activities involving the installation or removal of traffic management must be carried out after making reference to the appropriate risk assessment and method statement found in the library of traffic management documentation.

Related to Subject Proceedings

  • CCAA Proceedings means the proceedings commenced by the Applicant under the CCAA as contemplated by the Initial Order;

  • Insolvency Proceedings means, as to any Person, any dissolution, winding up, liquidation, arrangement, reorganization, adjustment, protection, relief or composition of such Person or its debts, whether voluntary or involuntary, in any bankruptcy, insolvency, arrangement, reorganization, receivership, relief or other similar action or proceeding under any Insolvency Laws, or upon any assignment for the benefit of creditors or any marshalling of the assets of such Person, or otherwise.

  • Legal Action means and includes any claim, counterclaim, demand, action, suit, counterclaim, arbitration, inquiry, proceeding or investigation before any

  • Litigation means any action, suit or proceeding before any court, mediator, arbitrator or Governmental Authority.

  • Environmental Claims means any and all administrative, regulatory or judicial actions, suits, demands, demand letters, claims, liens, notices of noncompliance or violation, investigations or proceedings relating in any way to any Environmental Law.

  • Regulatory Proceeding means a request for information, civil investigative demand, or civil proceeding commenced by service of a complaint or similar proceeding brought by or on behalf of the Federal Trade Commission, Federal Communications Commission, or any federal, state, local or foreign governmental entity in such entity’s regulatory or official capacity in connection with such proceeding.

  • Adjudicative proceeding means an administrative matter resulting in an agency

  • Commenced means that an owner or operator has undertaken a continuous program of construction or modification or that an owner or operator has entered into a binding agreement or contractual obligation to undertake and complete, within a reasonable time, a continuous program of construction or modification.

  • Environmental Judgments and Orders means all judgments, decrees or orders arising from or in any way associated with any Environmental Requirements, whether or not entered upon consent or written agreements with an Environmental Authority or other entity arising from or in any way associated with any Environmental Requirement, whether or not incorporated in a judgment, decree or order.

  • Lawsuit means any lawsuit, arbitration or other dispute resolution filed by either party herein pertaining to any of this Warrant, the Facility Agreement and the Registration Rights Agreement.

  • Chapter 11 Cases means (a) when used with reference to a particular Debtor, the case pending for that Debtor under chapter 11 of the Bankruptcy Code in the Bankruptcy Court and (b) when used with reference to all the Debtors, the procedurally consolidated chapter 11 cases pending for the Debtors in the Bankruptcy Court.
