The Warranty Period runs from the date of Practical Completion (refer Part B: Form of Subcontractor Warranty).
Upon receipt from the District of notice of a failure of any of the Work to satisfy any Subcontractor Warranty, representation, guarantee, or obligation, the DB Contractor shall enforce or perform any such representation, Warranty, guarantee, or obligation, in addition to the DB Contractor’s other obligations hereunder.
Seller shall warrant the Work on the terms set forth in Article 16 below for twelve (12) months (“Warranty Period”) following the earlier of the date: (a) Unit #2 successfully passes all Performance Tests, or (b) Purchaser begins beneficial use of Unit #2, but in no event shall Seller’s warranty obligations with respect to any component of Unit #2 for which there is a separate Subcontractor Warranty extend beyond two (2) years after the date of actual Delivery of such component hereunder.

All parts and components employed in repairs and replacements shall be subject to the Subcontractor Warranty and Performance Guarantee (and warranty and guarantee provided by and have a level of quality and workmanship equivalent to or greater than that required of the Work as initially installed under this Agreement.
If prior to entering into a subcontract or supply agreement, a subcontractor or supplier identified in Attachment 11 informs the Contractor that it will not provide the form of the Subcontractor Warranty Deed, the Contractor must submit to the Superintendent for approval (which approval must not be unreasonably withheld) the form of warranty that the subcontractor or supplier is willing to provide in lieu of the Subcontractor Warranty Deed.
