Except for a written assignment of a portion of this Agreement to another property owner’s association within the Development (a “Subassociation”) as to specific Entryway Improvements to be maintained by the Subassociation, the Association may not assign, sublet or transfer its interest in this Agreement without the prior notice and written consent of the City.
In the event of any permitted assignment, whether to a Subassociation or following the City’s consent, the Association must deliver a copy of a written assignment, signed by the Association and the assignee, to the City, which must specifically identify the rights and obligations assigned and assumed, as well as the date of the assignment, and the name, address and contact information for the assignee.
Subject to the provisions of this Declaration and other provisions of law, the boundaries between adjoining Units may only be relocated by an amendment to this Declaration upon the affected Unit Owners’ application to the Board of the Subassociation in which they are Members.
When a Residential Unit owned by the Declarant is sold, the Declarant may apply funds collected at closing from the purchaser to reimburse itself for funds paid to the Master Association or Residential Subassociation for such contribution with respect to that Unit.
Any Assessments levied by a Subassociation shall be made solely upon its own Members and be allocated in the same manner had such levy been made by the Master Association.
