SUB- SUBLESSOR AND SUB-SUBLESSEE ACKNOWLEDGE BY THEIR INITIALS BELOW AND THEIR EXECUTION OF THIS LEASE THAT EACH OF THE INDEMNIFICATION PROVISIONS OF THIS LEASE(SPECIFICALLY INCLUDING BUT NOT LIMITED TO THOSE RELATING TO WORKER'S COMPENSATION BENEFITS AND LAWS) WERE SPECIFICALLY NEGOTIATED AND AGREED TO BY SUB-SUBLESSOR AND SUB-SUBLESSEE.
Through this Agreement, and subject to the condition precedent that the Sublessor delivers a copy to the Sublessee of the authorization referred in Section I (C) of the Statements above, the SUBSUBLESSOR leases to the SUBLESSEE, and the SUBLESSEE receives, the Place described and identified in the subsection D) of Statement I of this Agreement, together with the Inventory and the parking space referred therein.
Likewise, SUBSUBLESSOR also grants to the SUBLESSEE the non-exclusive right to use the common areas of the Building in which the Place is located, including, but not limited to, the restrooms, lobbies, elevators, sidewalks, and stairwells, that are used in common with other tenants (hereinafter, the "Common Areas”).
IN ANY AMICABLE ACTION OF EJECTMENT, SUB-SUBLESSOR SHALL CAUSE TO BE FILED IN SUCH ACTION AN AFFIDAVIT MADE BY IT OR SOMEONE ACTING FOR IT SETTING FORTH THE FACTS NECESSARY TO AUTHORIZE THE ENTRY OF JUDGMENT, AND, IF A TRUE COPY OF THIS SUB-SUBLEASE (AND OF THE TRUTH OF THE COPY SUCH AFFIDAVIT SHALL BE SUFFICIENT EVIDENCE) BE FILED IN SUCH ACTION, IT SHALL NOT BE NECESSARY TO FILE THE ORIGINAL AS A WARRANT OF ATTORNEY, ANY RULE OF COURT, CUSTOM OR PRACTICE TO THE CONTRARY NOTWITHSTANDING.
