Spouse or Surviving Spouse definition

Spouse or Surviving Spouse means, except as otherwise provided in the Plan, a person who is the legally married spouse or surviving spouse of a Participant.
Spouse or Surviving Spouse means, with respect to a Participant, the person who is treated as married to such Participant under the laws of the state in which the Participant resides, subject to the limitations of the Defense of Marriage Act. The determination of a Participant's Spouse or Surviving Spouse shall be made as of the earlier of the date as of which benefit payments from the Plan to such Participant are made or commence (as applicable) or the date of such Participant's death. In addition, a Participant's former Spouse shall be treated as his Spouse or Surviving Spouse to the extent provided under a qualified domestic relations order, as defined in Code Section 414(p).
Spouse or Surviving Spouse means, solely for the purposes of minimum distribution provisions, the natural person who is the Surviving Spouse of the Participant under Federal law. For all purposes under the Plan, the Plan Sponsor may rely on any written statement furnished to it, and the Plan Sponsor has no duty to inquire concerning the non-existence or identity of a Participant's Spouse unless the Plan Sponsor has received a court order or legal process or a written notice from any office of the IRS concerning the existence or non-existence or identity of the Participant's Spouse.

More Definitions of Spouse or Surviving Spouse

Spouse or Surviving Spouse means the spouse or Surviving spouse of the Participant. A former spouse shall be treated as the spouse or Surviving spouse of the Participant if specifically stated in a Qualified Domestic Relations Order. To the extent that a Qualified Domestic Relations Order does not redesignate a former spouse as the beneficiary of the Participant and the divorce decree is finalized, any prior beneficiary designation of the ex-spouse by a Participant shall be null and void.
Spouse or Surviving Spouse means the spouse or surviving spouse of the MPC Participant, provided that a former Spouse will be treated as the Spouse or Surviving Spouse to the extent required under a “qualified domestic relations order” as described in Section 414(p) of the Code.
