SPECIALTY RETAIL STORE definition

SPECIALTY RETAIL STORE means a commercial establishment which offers for sale or rent one merchandise line or a limited number of closely related merchandise lines, and without limiting the generality of the foregoing, may include such establishments as a book store, art store, framing store, florist shops, etc. A specialty retail store shall not include a “Convenience Store”, “Food Store”, “Department Store” or “Auto-Oriented Department Store”, as defined herein.
SPECIALTY RETAIL STORE means a retail store that, within the Territory, is known, identified, promoted or held out to the public as being part of a chain of retail stores with the following elements and characteristics: (i) all stores in the chain within the Territory operate under the same nationally or regionally recognizable brand name (regardless of whether such stores are operated by one owner or by different franchisees), (ii) the chain consists of more than eighty (80) retail stores within the Territory (or, for purposes of the limitations on DTR Licenses granted by TDSF and/or its Affiliates to one (1) or more chains of Children’s Specialty Retail Stores set forth in Section 6.2.2, the chain of Children’s Specialty Retail Stores consists of more than sixty (60) retail stores within the Territory), (iii) the average size of stores within the chain within the Territory is less than twenty thousand (20,000) gross leaseable square feet, (iv) all stores within the chain within the Territory primarily offer Softlines and/or Hardlines with a specific emphasis on one category or type of consumer product (e.g., apparel, cookware, electronics, music, etc.) as opposed to a wide variety of consumer products organized by department or otherwise, such as in a Department Store, and (v) the stores within the chain within the Territory generally offer merchandise on a full-retail pricing model rather than a discount or warehouse pricing model, except for periodic promotional and seasonal sales.”
SPECIALTY RETAIL STORE has the meaning specified in the License and Conduct of Business Agreement.

  • An order under section 199 (order for delivery up in criminal proceedings) shall not, in any case, be made after the end of the period of six years from the date on which the illicit recording in question was made.

  • TO QUALIFY FOR THE EXEMPTION UNDER THIS SECTION, THE PERSON WHO OWNS OR OPERATES A TOBACCO SPECIALTY RETAIL STORE SHALL FILE AN AFFIDAVIT WITH THE DEPARTMENT ON OR BEFORE THE EXPIRATION OF 30 DAYS AFTER THE EFFECTIVE DATE OF THE EXEMPTION IF THE TOBACCO SPECIALTY RETAIL STORE IS IN EXISTENCE ON THE EFFECTIVE DATE OF THIS SECTION OR 30 DAYS OR MORE BEFORE HE OR SHE WISHES TO USE THIS EXEMPTION, AND ON JANUARY 31 OF EACH YEAR AFTER THE EFFECTIVE DATE OF THE EXEMPTION.

  • THE AFFIDAVIT SHALL BE SIGNED BY THE OWNER OR OPERATOR OF THE TOBACCO SPECIALTY RETAIL STORE AND SHALL CERTIFY THAT THE TOBACCO SPECIALTY RETAIL STORE MEETS ALL OF THE FOLLOWING REQUIREMENTS: (A) IN THE 30-DAY PERIOD IMMEDIATELY PRECEDING THE FILING OF THE FIRST AFFIDAVIT UNDER THIS SUBSECTION, THE TOBACCO SPECIALTY RETAIL STORE GENERATED 75% OR MORE OF ITS TOTAL GROSS ANNUAL INCOME FROM THE ON-SITE SALE OF TOBACCO PRODUCTS AND SMOKING PARAPHERNALIA.

  • HOWEVER, IF THE AFFIDAVIT REMAINS UNFILED AFTER THE 21-DAY GRACE PERIOD, THE CIGAR BAR OR TOBACCO SPECIALTY RETAIL STORE IS NOT EXEMPT FROM THE SMOKING PROHIBITION OF SECTION 12603 AND SHALL IMMEDIATELY PROHIBIT SMOKING ON ITS PREMISES.

  • Retail Store – means any business facility that sells goods directly to the consumer whether for or not-for-profit, including, but not limited to, retail stores, restaurants, pharmacies, convenience and grocery stores, liquor stores, as well as seasonal and temporary businesses.

  • Retail tobacco store means a retail store utilized primarily for the sale of tobacco products and accessories and in which the sale of other products is merely incidental.

This includes, but is not limited to, a long-term acute care unit, an acute mental health or acute short-term rehabilitation unit or hospital. Hospital does not mean: • convalescent home; • rest home; • nursing home; • home for the aged; • school and college infirmary; • residential treatment facility; • long-term care facility; • urgent care center or freestanding ambulatory surgical center; • facility providing mainly custodial, educational or rehabilitative care; or • a section of a hospital used for custodial, educational or rehabilitative care, even if accredited by the JCAHO or listed in the AHA directory.

  • Specialty contractor means a person who is licensed to conduct business as described in subsection 4 of NRS 624.215.

  • Distribution center means a building or structure used primarily for the storage of goods which are intended for subsequent shipment to retail outlets. Distribution center does not mean a building or structure used primarily to store raw agricultural products, used primarily by a manufacturer to store goods to be used in the manufacturing process, used primarily for the storage of petroleum products, or used for the retail sale of goods.

  • Retail marijuana store means an entity licensed to purchase marijuana from marijuana cultivation facilities and marijuana and marijuana products from marijuana product manufacturing facilities and to sell marijuana and marijuana products to consumers.

  • Specialty coating means any coating that is manufactured and used for one (1) of the following specialized applications:

  • Marijuana retailer means a person who sells marijuana items to a consumer in this state.

  • Sale at retail or "retail sale" means the act or attempted act of selling, bartering, exchanging, or

  • Flexible vinyl adhesive means an aerosol adhesive designed to bond flexible vinyl to substrates. Flexible vinyl means a nonrigid polyvinyl chloride plastic with at least five percent, by weight, of plasticizer content.
