Specially Designated National. SDN”, “Blocked Person”, or other banned or blocked person, entity, nation, or transaction pursuant to any law, order, rule or regulation that is enforced or administered by OFAC or another department of the United States government, (b) Buyer is not acting on behalf of any such person, group, entity, or nation, and (c) Buyer is not engaged in this transaction on behalf of, or instigating or facilitating this transaction on behalf of, any such person, group, entity or nation.

Specially Designated National or “Blocked Person” means (i) a person designated by the U.S. Department of Treasury’s Office of Foreign Assets Control from time to time as such status, (ii) a person described in Section 1 of U.S. Executive Order 13224, issued September 23, 2001, or (iii) a person otherwise identified by government or legal authority as a person with whom we or our affiliates are prohibited from transacting business. Specially Designated National means a person named as a “specially designated national and blocked person” on the most current list published by OFAC at its official website or any replacement website or other replacement official publication of such list;

• The Bidder further represents and warrants to the Ho-Chunk Nation that the Bidder and its principles, shareholders, members, partners, or affiliates, as applicable, are not directly or indirectly, engaged in, and are not facilitating, the transactions contemplated by this Agreement on behalf of any person or entity named as Specially Designated National and Blocked Person.

• Purchaser reserves the right to deny access to Purchaser’s or its customer’s premises to any person who appears on government-issued lists of terrorists, suspects, etc., such as the Department of State, Arms Export Control Debarment List; Department of State, Proliferation List; Department of Commerce, Denied Parties List; and Department of Treasury, Specially Designated National List.

• Contractor is not designated as a Specially Designated National by querying the Specially Designated Nationals List maintained by the United States Department of the Treasury, Office of Foreign Assets Control:http://www.treas.gov/offices/enforcement/ofac/sdn/.

• Tenant hereby represents and warrants that neither Tenant nor any officer, director, employee, partner, member or other principal of Tenant (collectively, “Tenant Parties”) is listed as a Specially Designated National and Blocked Person (“SDN”) on the list of such persons and entities issued by the U.S. Treasury Office of Foreign Assets Control (OFAC).

• Bidder represents and warrants to the Ho-Chunk Nation the neither it nor any of its principles, shareholders, members, partners or affiliates, as applicable, is a person or entity named as a Specially Designated National and Blocked Person (as defined in Presidential Executive Order 13224) and that it is not acting, directly or indirectly, for or on behalf of a Specially Designated National and Blocked Person.

More Definitions of Specially Designated National

Specially Designated National has the meaning set forth in Section 3.6(c).

Specially Designated National or “Blocked Person” shall mean (1) a person designated by the U.S. Department of Treasury's Office of Foreign Assets Control or other governmental entity from time as a "specially designated national or blocked person" or similar status, (2) a person described in Section 1 of U.S. Executive Order 13224, issued on September 23, 2001, or (3) a person otherwise identified by government or legal authority as a person with whom Hard Rock or any of their affiliates, are prohibited from transacting business. As of the date hereof, a list of such designations and the text of the Executive Order are published under the internet website address www.ustreas.gov/offices/enforcement/ofac.

Specially Designated National. Blocked Entity," "Specially Designated Terrorist," "Specially Designated Narcotics Trafficker" or "Foreign Terrorist Organization," as defined by the U.S. Office of Foreign Assets Control.

Specially Designated National or "Blocked Person" (identified in 31 CFR, Subtitle B, Chapter V, Appendix 1) thereof or with any other person subject to sanctions under any of the foreign assets control regulations of the United States Treasury Department (31 CFR, Subtitle B, Chapter V, as amended) or any enabling legislation or executive order relating thereto, or any person or entity in those countries or with those persons, or perform contracts in support of projects in or for the benefit of those countries or those persons.

Specially Designated National means a Person who is on the United States Office of Foreign Assets Controls’ list of Specially Designated Nationals, the U.S. Department of Commerce’s Bureau of Industry and Security’s list of denied persons or the Department of State’s Directorate of Defense Trade Controls’ lists of debarred parties, as each may be amended from time to time.

Specially Designated National has the meaning assigned to it in Section 4.18 hereof.

Specially Designated National means a person determined by the Secretary of Treasury to be a specially designated national, any person acting for or on behalf of a designated foreign country, and any partnership, association, corporation, or other organization owned or controlled directly or indirectly by the Government of a designated foreign country or of a designated foreign national.
