Silent Second Mortgage definition

Silent Second Mortgage or “Silent Second” means an amount equal to $ , which is equal to the difference between the Fair Market Value of the property as of the date of this Declaration, and the Affordable Price paid by the Owner, which mortgage is a condition of Owner’s agreement to purchase the property, as required by Winters Municipal Code section 17.200.080(B)(2)(b), and which is payable upon sale of the property to a purchaser other than a Qualifying Purchaser.
Silent Second Mortgage means a mortgage loan in second lien position that has no payment or interest obligations.
