Settlement Costs definition

Settlement Costs means all costs incurred in the Action by the Class and Class Counsel, including but not limited to expert witness fees, costs of settlement administration and notice, any attorneys’ fees awarded to Class Counsel by the Court, and fees of a special master for settlement approval should one be appointed by the Court.
Settlement Costs means the following, when they arise from a “claim”:
Settlement Costs means all costs of the settlement including the costs of carrying out the Notice Program, as set forth in Paragraph 4, Claims Administration, any Attorneys’ Fees and Expenses Award, any Service Award to Representative Plaintiffs and all other expenses or costs related to the settlement including the costs of serving notices under the Class Action Fairness Act of 2005, 28 U.S.C. § 1715, and Award payments to the Settlement Class Members.

  • The Claims Administrator must use the funds available in the Net Settlement Fund (after payment of Settlement Costs as defined above) to make payments for approved claims in this order: documented Unreimbursed Economic Losses, followed by lost time, followed by credit monitoring, followed by payments for approved claims for pro rata alternative cash payments.

Settlement Costs means all costs and obligations incurred, owing, paid or payable by the Borrower or any Subsidiary of the Borrower in connection with the settlement of any Specified Claim, including, without limitation, payment of restitution, fines and penalties, but excluding amounts payable to legal counsel or other advisors of the Borrower or any Subsidiary of the Borrower.
