Service & Term. XOOM Energy Ohio, LLC (“XOOM” or “Company”) agrees to act as your exclusive natural gas supplier and will provide competitive retail natural gas service to you. The Term of this Agreement will begin on the next available meter read date after processing of the request by XOOM and your gas utility, and will continue for the Contract Term as set forth in the accompanying Contract Summary, which is incorporated into this Agreement. Acceptance into the Program:These terms and conditions are subject to your acceptance into the program by both XOOM and your local utility. You will be promptly notified if you are not accepted into the program. Switching fees may apply to you under your local utility’s tariff if you are accepted into the program by both XOOM and your local utility.

Except for the foregoing, under no circumstances shall the Provider be obligated to extend the Service Term; provided, however, in the event such an Extension Term is so applicable and/or agreed upon, the Parties agree that the Service Fees shall increase in accordance with Section 3.1. Subject to the foregoing, any services so performed by the Provider (or its designees) as a result of an extension shall continue to constitute Services and be subject in all respects to the provisions of this Agreement.
Any extension to the Service Term (an “Extension Term”) hereunder shall require the prior written agreement of the Parties, not to be unreasonably withheld, conditioned or delayed.
If, during the Service Term or Extension Term, the Provider discovers that it does not possess any Authorization required for the Provider to perform the Services in accordance with this Agreement, or additional Authorizations are needed to perform any Service, the Provider shall use commercially reasonable efforts to obtain such Authorizations.

Service & Term. The purpose of this Agreement is to authorize XOOM to switch your natural gas provider to XOOM Energy Pennsylvania, LLC (“XOOM Energy” or “Company”) to become your exclusive natural gas supplier. The term of this Agreement will begin with your first meter read by your local utility (natural gas distribution company (“NGDC”)) following your acceptance into the program and will continue for twelve (12) months.

The term of this Agreement will begin when your local utility switches your account to XOOM and will continue for the Contract Term set forth in the accompanying Contract Summary. Service & Term. XOOM Energy Illinois, LLC (“XOOM” or “Company”) is licensed as an Alternative Retail Electric Supplier (“ARES”) with the Illinois Commerce Commission (“ICC”) in the State of Illinois. XOOM agrees to act as your exclusive electric power supplier. The term of this Agreement will begin when your local utility switches your account to XOOM and will continue for twelve (12) months.
Service & Term. XOOM Energy Michigan, LLC (“XOOM” or “Company”) agrees to act as your exclusive natural gas supplier. The term of this Contract will begin with your first bill issued by Consumers Energy on behalf of XOOM following your confirmation into the SureLock 12 program and will continue for 12 months. Acceptance into the Program:These terms and conditions are subject to your acceptance into the program by both XOOM and Consumers Energy. In addition to an email confirmation, a Confirmation Letter, which will include a hard copy of this Contract, will be mailed to you within 7 days of signing this contract with XOOM Energy.
Service & Term. You will continue to receive a single ▇▇▇▇ from your EDC. Should you cancel your service before the end of the initial term specified in your selected plan, you will be subject to an early termination fee. If you are a new Customer, your product selection will become effective on the day your service begins with Tomorrow Energy, which is the next available meter reading date after processing the request by the EDC and Tomorrow Energy. Because this date is determined by your EDC, Tomorrow Energy cannot commit to a specific date for the commencement of service. If you are currently a Tomorrow Energy Customer and are switching to another Tomorrow Energy product, your product selection will become effective within twenty- four (24) hours of your request to switch to the new plan. Contract Renewal: This Agreement does not renew automatically. A contract expiration notice explaining your renewal options will be sent to you at least forty-five (45) days but no more than ninety (90) days prior to the end of your term. At the end of the term, if you do not choose a new plan, your plan will rollover to a month-to-month variable rate plan whose rate is set by Tomorrow Energy, in its sole discretion. Pricing & Payment: Monthly you will receive a single ▇▇▇▇ from your EDC that includes Tomorrow Energy generation supply charges and energy service fee, as well as the EDC’s delivery charges. Your payment will be due to the EDC by the date specified in the EDC ▇▇▇▇. Access to Customer Information: Customer acknowledges that customer billing and payment information will be provided to Tomorrow Energy from your EDC. This information includes, but is not limited to, Customer’s account number, meter reading data, rate class and electric usage, Customer’s address(es) and telephone number, and Customer’s budget billing plan or payment arrangement preference. Except in the case of credit or collections requirements, we will not disclose your information to any third party without your prior written authorization. You may request up to twenty-four (24) months of your historical payment data at no charge. Tomorrow Energy is prohibited from disclosing your social security number and/or account number(s) without your consent except for Tomorrow Energy’s own collections and credit reporting, participation in programs funded by the universal service fund, pursuant to section 4928.52 of the Revised Code, or assigning a contract to another CRES provider.
Service & Term. XOOM Energy Washington D.C., LLC (“XOOM”) is licensed by the Public Service Commission of the District of Columbia (“DC PSC”), license No. EA 2013-28, to offer and supply electricity in the District of Columbia and is a qualified electricity supplier under your local distribution company’s (“LDC’s”) tariff. In this Agreement, XOOM agrees to act as your exclusive electricity supplier. XOOM will supply electricity to your LDC based on how much you consume, and your LDC will deliver the electricity to you. The DC PSC does not regulate XOOM’s prices for electricity. The Term of this Agreement is set forth in the accompanying Contract Summary which is incorporated by reference herein. Acceptance into the Program: These terms and conditions are subject to your acceptance into the program by both XOOM and your LDC. You will be promptly notified with confirmation of the switch to XOOM in writing. LDC Services: XOOM is an Electric Generation Supplier and is not affiliated with your LDC. Your LDC will continue to deliver your electric power, read your meter, make necessary repairs, and send you a bill. Your LDC will also respond to emergencies and provide other basic utility services as required. Please call your LDC in the event of an emergency such as a power outage. XOOM is not an agent of your LDC, and your LDC will not be liable for any of XOOM’s acts, omissions, or representations. Price: XOOM will calculate your monthly electricity bill by multiplying (i) the price of electricity per kilowatt hour (“kWh”) by (ii) the amount of electricity used during the billing cycle. Your price per kWh will be a fixed price as set forth in the Contract Summary. Additionally, you will be required to pay a monthly administrative fee which is also set forth in the accompanying Contract Summary which is incorporated by reference herein. Your price does not include, and you are required to pay, applicable taxes and fees. Your price also does not include your LDC’s charges, for which you are responsible. Your LDC’s rate for standard offer electricity service likely will change from time to time and, therefore, XOOM cannot guarantee savings over the LDC’s rates for the entire Term of this Agreement.
