Senior Exchange Securities definition

Senior Exchange Securities means (1) the 9.875% Senior Notes Due 2019 issued pursuant to the Senior Notes Indenture in connection with the Registered Exchange Offer pursuant to the Senior Notes Registration Rights Agreement and (2) Additional Senior Notes, if any, issued pursuant to a registration statement filed with the SEC under the Securities Act.
Senior Exchange Securities means any securities (other than Common Stock) into which any Senior Note is converted or exchanged (excluding any securities of the same class or series that are not issued to the holder thereof upon conversion or exchange of the Senior Note);
Senior Exchange Securities means senior notes issued by the Issuers under the Indenture containing terms identical to the Securities (except that the Senior Exchange Securities will not be subject to restrictions on transfer or to any increase in annual interest rate for failure to comply with this Agreement), and to be offered to Holders of Securities in exchange for Securities pursuant to the Exchange Offer.
