As further provided below under Section 6.1, Artist shall be solely liable for any claim for any royalty fees or charges that might be brought against ArtisTech by a performing rights licensing organization including, without limitation, ASCAP, BMI, SESAC, SOCAN, SACD, SACEM, GEMA, PRS, etc.
The Exhibitor alone is responsible for obtaining the necessary authorizations and more particularly but not exhaustively for the sale of alcoholic or non-alcoholic beverages, for broadcasting music, by making the necessary declarations to SACEM, for the freely available use of intellectual property rights, signs, trademarks, etc., used on its stand.
The Service Provider’s rate does not include broadcasting-related fees and charges due to SACEM and other related fees, due upon the first request for royalty services, except for royalty-free music, whose certificates are sent free of charge to Clients subject to obtaining their complete contact details and them having adequate authority to gather and/ or transmit this information internally.
The Exhibitor undertakes to pay any fees and taxes due to royalty collection societies such as SACEM (music), SACD (literature), etc.
All Exhibitors will ensure compliance with S.A.C.E.M obligations if they use music on their Stands and for their own activities, even if simply for the demonstration of sound equipment.
The Artist [Licensee/▇▇▇▇▇] agrees that he/she will register the Producer’s interest, on the Producer’s behalf, at the collection society in the Artist’s home territory to ensure that mechanical and performance royalties are collected throughout the world.[BMI, ASCAP, SACEM, GEMA, PRS etc…] The Artist [Licensee/Buyer] shall use the Producer’s membership number and follow the directions contained in the email that shall be sent to the Artist by the Producer/Composer.
Music Service hereby grants to Licensee a waiver regarding any obligation to pay fees to applicable performance rights societies throughout the Territory (including but not limited to ASCAP, BMI, SESAC, PRS, GEMA, SACEM), and internet performances (Sound Exchange, etc.).

The tracks/master recordings as referred to in article 2 of this agreement do not interfere with any legal representation of a collection society anywhere in the world, including without limitation ASCAP, BMI, SESAC, SOCAN, PRS, PPL, ▇▇▇▇/STEMRA, ▇▇▇▇▇ ▇▇▇ Agency, GEMA, SACEM, SGAE, AGEDI, AIE, DAMA and/or JASRAC, concerning the collection of copyrights and neighbouring rights.
Our economic model is associative and does not make any advertising profit : besides, the work which is broadcast is not entirely under SACEM ‘s repertoire.
