Maple shall, at its sole expense, develop the Road in material conformance with the Road Plans, provided, however, the improvements in the Road shall be subject to review and approval by the fire marshal and CSX Railroad and the Road Plans may be revised to the extent required by the fire marshal or CSX Railroad.
