This section covers occupational exposure of contractors to chemical and physical agents at Motiva facilities and installations (like Retail Sites).
As of the Closing of this Agreement, and irrespective of whether Operator Franchisee accepts, rejects or challenges the BFO, whether Operator Franchisee closes escrow, or whether Buyer owns, operates, manages or supplies the BFO Fuel Retail Site, each of the BFO Fuel Retail Sites shall be deemed to be a Purchased Asset for purposes of Third Party Claims, Retained Environmental Liabilities and Assumed Environmental Liabilities.
Upon such conveyance of any such BFO Fuel Retail Sites to Buyer at Closing, such BFO Fuel Retail Sites shall be deemed to be a Purchased Asset for all purposes under this Agreement, retroactive to the Closing Date.

In the event that such Purchaser fails to do so to the satisfaction of the Seller or the applicable Supplier, subject to applicable law, the Seller and the Supplier (i) shall have the right to cause any and all signage, placards, and other displays bearing the Proprietary Marks to be removed from the Retail Sites; and (ii) shall have the right to use any means necessary to remove, cover or obliterate the Proprietary Marks, including entry to the Retail Sites to do so.
