Restricted Expenditures definition

Restricted Expenditures means each of the following, to the extent declared, made or committed to be made by Borrower or any of its Restricted Subsidiaries during any Restricted Period:
Restricted Expenditures means the sum of (a)(x) Restricted Payments made after the Effective Date pursuant to Section 6.08(a)(ii), (y) Restricted Payments made after the Effective Date pursuant to Section 6.08(a)(iii) and (z) Repurchase Expenditures made after the Effective Date pursuant to Section 6.08(b)(iv), plus, without duplication, (b) Restricted Payments or Repurchase Expenditures made on or after July 1, 2006 and prior to the Effective Date pursuant to Section 6.08(a)(ii) or Section 6.08(b)(iv) of the Existing Agreement.
Restricted Expenditures. Restricted Expenditures Allowance" and "Restricted Expenditures Basket" shall have the meanings specified in Section 6.4.

Restricted Expenditures means, for any fiscal quarter, the sum of (a) the Capital Expenditures of the Borrower and its Subsidiaries in 109 such fiscal quarter plus (b) the amount applied by the Borrower and its Subsidiaries in such fiscal quarter to the optional repayment, redemption or repurchase of Funded Debt, provided that there shall be excluded from Restricted Expenditures any expenditures with respect to any Casualty Loss to the extent of any insurance proceeds received with respect to such Casualty Loss.
Restricted Expenditures means (a) Distributions, (b) Capital Expenditures (other than (i) Capital Expenditures for the completion of Bellagio and Beau Rivage in substantial accordance with the construction plans in existence on the Closing Date and (ii) Maintenance Capital Expenditures), (c) the purchase price paid in Cash for Acquisitions net of any Indebtedness incurred to finance such Acquisitions that is non-recourse to the credit or assets of Borrower or any Core Asset and (d) Investments in New Venture Entities which are not Subsidiaries of Borrower, in each case made by Borrower or any of the Restricted Subsidiaries.

  • Planned Expenditures shall have the meaning provided in the definition of the term Excess Cash Flow.

  • Qualified expenditures means capital expenditures that qualify, or would qualify except that the taxpayer entered into an agreement under subsection (13), for a rehabilitation credit under section 47(a)(2) of the internal revenue code if the taxpayer is eligible for the credit under section 47(a)(2) of the internal revenue code or, if the taxpayer is not eligible for the credit under section 47(a)(2) of the internal revenue code, the qualified expenditures that would qualify under section 47(a)(2) of the internal revenue code except that the expenditures are made to an historic resource that is not eligible for the credit under section 47(a)(2) of the internal revenue code that were paid. Qualified expenditures do not include capital expenditures for nonhistoric additions to an historic resource except an addition that is required by state or federal regulations that relate to historic preservation, safety, or accessibility.

  • Operating Expenditures means all Partnership Group expenditures, including, but not limited to, taxes, reimbursements of the General Partner, repayment of Working Capital Borrowings, debt service payments and capital expenditures, subject to the following:

  • local expenditures means expenditures in the currency of the Borrower or for goods or services supplied from the territory of the Borrower; and

  • Permitted Capital Expenditures has the meaning given that term in Section 9.12(b).

  • Net Capital Expenditures means for any period the amount by which Capital Expenditures during such period exceeds reimbursements for such items during such period from any fund established pursuant to the Loan Documents.

  • Investment Capital Expenditures means capital expenditures other than Maintenance Capital Expenditures and Expansion Capital Expenditures.

  • Capitalized Expenditures means those expenditures that (i) would be capitalized under generally accepted accounting principles, and (ii) are incurred with respect to Shared-Loss Loans, Other Real Estate, Additional ORE or Subsidiary ORE. Capitalized Expenditures shall not include expenses related to environmental conditions including, but not limited to, remediation, storage or disposal of any hazardous or toxic substances or any pollutant or contaminant.

  • Expansion Capital Expenditures means cash expenditures for Acquisitions or Capital Improvements. Expansion Capital Expenditures shall include interest (including periodic net payments under related interest rate swap agreements) and related fees paid during the Construction Period on Construction Debt. Where cash expenditures are made in part for Expansion Capital Expenditures and in part for other purposes, the General Partner shall determine the allocation between the amounts paid for each.

  • Capital Expenditure Reserve means, on an annual basis, an amount equal to $0.15 per square foot for each property owned by a Borrower or the Parent (or a Subsidiary thereof).

  • Permitted Expenses shall include, without limitation, the expenses set forth in Sections 5.10 and 9.2 hereof.

  • Expenditures means payments and contracts for goods, services, and construction which may be acquired competitively and are not regulated by separate authority, and, where the department acts as the sole or primary contracting officer and has selective discretion as to the supplier, vendor, or contractor. This definition does not apply to expenditures by the department of transportation for road and bridge construction projects which receive federal funds under section 112(b) of title 23 of the United States Code, 23 U.S.C. 112, 23 C.F.R. 635.104(a), and other applicable federal law until federal law recognizes small businesses owned by persons with disabilities.

  • Capital Expenditure means expenditure on:

  • Unfinanced Capital Expenditures means, for any period, Capital Expenditures made during such period which are not financed from the proceeds of any Indebtedness (other than the Revolving Loans; it being understood and agreed that, to the extent any Capital Expenditures are financed with Revolving Loans, such Capital Expenditures shall be deemed Unfinanced Capital Expenditures).

  • Consolidated Maintenance Capital Expenditures means, for any period, the aggregate amount of expenditures for additions to property, plant, and equipment that are not Consolidated Expansion Capital Expenditures.

  • Maintenance Capital Expenditure means cash expenditures (including expenditures for the construction of new capital assets or the replacement, improvement or expansion of existing capital assets) by a Group Member made to maintain, over the long term, the operating capacity or operating income of the Partnership Group. For purposes of this definition, “long term” generally refers to a period of not less than twelve months.

  • Consolidated Capital Expenditures means, with reference to any period, the Capital Expenditures of the Borrower and its Subsidiaries calculated on a consolidated basis for such period.
