Residential Common Areas definition

Residential Common Areas means those parts of the Residential Development intended for the common use and benefit of the Residential Development as a whole and not just any particular Residential Unit or any particular part thereof and which are, subject to the provisions of this Deed, to be used by each Owner and Occupier of the Residential Units in common with all other Owners and Occupiers of the Residential Units which said parts include but not limited to:-
Residential Common Areas. Those parts of the Lot and the Development designed or intended for the common use and benefit of the Owners of the Residential Units and not otherwise specifically assigned to or for the exclusive use of an Owner of a Residential Unit (which do not form part of the Units, the Estate Common Areas, the Commercial Common Areas or the Car Park Common Areas) and shall include but not limited to :- (a) the Recreational Areas; (b) the Visitors’ Car Parks; (c) the Disabled Parking Space; (d) bicycle parking spaces on Ground Floor provided pursuant to Special Condition No.(24)(e) of the Government Grant (“Bicycle Parking Spaces”) for the parking of bicycles belonging to the residents of the Residential Units and their bona fide guests, visitors or invitees; (e) the loading and unloading space on Second Floor provided pursuant to Special Condition No.(25)(a)(i) of the Government Grant and for the purpose of identification only as shown and marked “L1” on the Second Floor Plan annexed hereto; (f) cable riser room, transformer room, low voltage switch room, lift pit, filtration plant room, entrance lobby, part of the Greenery Areas, lift lobbies and corridors (including widen lift lobbies as for identification purpose only shown and coloured Yellow Cross-hatched Black on the plans (certified as to its accuracy by the Authorized Person) hereto annexed), cable duct, covered landscape, green roof, planters, staircases and landings, hose reels, steel platform, flat roofs, air-conditioning platforms, pipe ducts, vent ducts, meter rooms, refuse storage and material recovery xxxxxxxx, fire services pipe ducts, electrical and extra low voltage rooms, canopies, light well; (g) parts of the External Walls of the Development as for identification purpose only shown and coloured Yellow on the Elevation Plans (certified as to its accuracy by the Authorized Person) hereto annexed; (h) enclosing walls of the Residential Common Areas (but in the case of such enclosing walls adjoining any Unit(s), excluding the plaster and covering of the internal surface of such enclosing walls within the relevant Unit(s)); (i) structural walls, partitions, columns, beams, floor slabs and other structural elements and supports of or within Residential Units or any of them; (j) parts of Noise Mitigation Measures including the acoustic fins, sound absorption materials and blank walls/non-noise sensitive facade which are for the purpose of identification shown and coloured Red, Light Pink and Light Gre...
Residential Common Areas means all those areas or parts of the Land and the Development the right to the use of which is designated for common use and benefit of the Owners and occupiers of Residential Units and is not given by this Deed to the Owner of any individual Residential Unit and which, without limiting the generality of the foregoing, include: - (i) Visitors’ Parking Spaces, Parking Spaces for Disabled Persons, Bicycle Parking Spaces, and Loading and Unloading Spaces; (ii) Recreational Facilities; (iii) Greenery Areas; (iv) driveway (excluding those forming part of the Car Park Common Areas or Development Common Areas) and emergency vehicular access (excluding those forming part of the Development Common Areas); (v) external walls of the Residential Units including the curtain wall system and the Green and Innovative Feature(s) being the non-structural prefabricated external walls forming part of external walls of the Residential Units (excluding, for the avoidance of doubt, the windows and window frames of any Residential Unit and the common walls adjoining separate Residential Units or dividing the land upon which the Residential Units are constructed), all walls on the roof level of Maisonette Units (including, without limitation, the external parapet(s) and common fence walls on roof level between two adjoining Maisonette Units); and (vi) telecommunications and broadcasting equipment room(s), sprinkler water tank(s), sprinkler pump room(s), fire services & sprinkler pump room(s), fire services water tank(s), check meter cabinet(s), lifts, lift lobbies, sprinkler tank(s), potable water tank(s), flushing water tank(s), potable & flushing water pump room(s), fire services sprinkler control valve room(s), potable water pump and tank room(s), fire services pump room(s), hose reel pump room(s), check water meter room(s), electric meter room(s), hard paved footpath(s), electrical and mechanical room(s), extra low voltage room(s), pipe duct(s), water meter cabinet(s), light well(s), electric meter and electric low voltage room(s), planters, management office, electric meter duct(s), telephone duct(s), electric duct(s), air- conditioning duct(s), gas duct(s), air-conditioning platforms, water meter room(s), flat roof(s), electric low voltage duct(s), fire services duct(s), hose reels, gas / fire services / cable riser duct(s), roof(s), top roof(s), green roof(s), main roof(s), emergency generator room(s), air-conditioning plinth(s), communal aerial broadcast distribution equi...

Residential Common Areas means such of the roofs and flat roofs (unless otherwise specifically included in a Residential Unit as shown in the Plans), the resident’s club (which includes, without limitation, an exercise room, game rooms and landscaped areas), lift machine rooms, switch rooms, meter rooms, flushing water pump room, potable pump room, telecommunication and broadcasting equipment room, fan rooms, water pump rooms, entrance lobbies, lift lobbies, halls, lift pits and lift shafts of the Residential Towers, passageways, staircases, steps, ramps, corridors, planters, refuge floors, architectural fins, covered walkway, pump rooms and water tanks, cable and pipe ducts, and such areas and spaces containing the Residential Common Facilities and other areas and spaces in any part or parts of the Estate which are for the common use and benefit of the tenants and occupiers of Residential Units, and the Residential Common Areas are shown for the purpose of identification only on the Plans (insofar as such areas and spaces are identifiable on such plans) and thereon coloured Indigo and Indigo Stippled Black EXCLUDING those areas being part of the Estate Common Areas, the Carpark Area, the Elderly HUB, the RCHE, the Day Care Centre and the Residential Units but INCLUDING such other areas as may be designated by the Developer as Residential Common Areas from time to time;
Residential Common Areas means those parts of the Building intended for the common use and benefit of all Residential Owners and not for a particular Residential Unit or Units which parts are subject to the provisions of this Deed to be used by each Residential Owner and Occupier in common with all other Residential Owners and Occupiers of the Land and the Building. The said parts include but are not limited to external walls, parapet walls, common passage but shall exclude any Car Park Common Areas and Building Common Areas and shall include reference tocommon parts” as defined in the BMO. Residential Common Areas means those portions of the Common Areas reserved, allocated or designated for use by the Owners and Occupants of Residential Lots.

Related to Residential Common Areas

  • Building Common Areas means with respect to the Tower, the areas, facilities and amenities specified in Schedule [E] which are to be used and enjoyed in common with all the other Apartment Acquirers of the Units in the Building; and

  • Common Areas is defined as all areas and facilities outside the Premises and within the exterior boundary line of the Industrial Center and interior utility raceways within the Premises that are provided and designated by the Lessor from time to time for the general non-exclusive use of Lessor, Lessee and other lessees of the Industrial Center and their respective employees, suppliers, shippers, customers, contractors and invitees, including parking areas, loading and unloading areas, trash areas, roadways, sidewalks, walkways, parkways, driveways and landscaped areas.

The term "BUILDING COMMON AREAS," as used in this Lease, shall mean the portions of the Common Areas located within any building in the Project not entirely leased by Tenant, which Building Common Areas shall be reasonably designated as such by Landlord. Notwithstanding the foregoing and subject to (i) Landlord's approval, which approval (as indicated in Section 29.4 below) shall not be unreasonably withheld or delayed, (ii) the CC&R's, and (iii) all terms of this Lease regarding Hazardous Materials, Tenant may install or locate such items as benches, patio tables, bike racks, above-ground generators, security cameras and the like (collectively, "MISCELLANEOUS COMMON AREA ITEMS") at Tenant's sole cost in the Common Areas or on the exterior of the Building, as applicable, provided that Tenant removes such items upon the expiration or earlier termination of this Lease and repairs any damage to the Common Areas or the exterior of the Building (as applicable) resulting from such removal. If Tenant fails to remove any Miscellaneous Common Area Item or to repair any damage resulting from such removal upon the expiration or earlier termination of this Lease, Landlord may do so and may charge Landlord's actual cost thereof to Tenant. The manner in which the Common Areas are maintained and operated shall be in accordance with a standard which is not less than that customarily followed in the operation and maintenance of first class mid-rise office buildings located within the University Towne Center (i.e., the area from two (2) blocks to the North of La Jolla Village Drive to two (2) blocks to the South of La Jolla Village Drive between the I-5 and I-805 freeways), Del Mar, Carmel Valley and Torrey Hills geographical areas, provided that Landlord shall manage, maintain and operate the same in a manner consistent with that of Comparable Buildings, and the use thereof shall be subject to such rules and regulations as Landlord reasonably may make from time to time. As used herein, "COMPARABLE BUILDINGS" shall mean the first class mid-rise office buildings (now existing or subsequently constructed) within the projects located within the University Towne Center, Del Mar, Carmel Valley and Torrey Hills geographical areas and having substantially similar characteristics to the Building pertaining to size, age, accessibility, design, quality, amenities and tenancies. Landlord reserves the right to make alterations or additions to, or to change the location of, elements of the Project and the Common Areas, provided that if any such changes might affect Tenant's use of the Premises (in other than an immaterial manner), Landlord obtains Tenant's prior written approval of any such alterations, additions and changes and such alterations, additions and changes do not unreasonably interfere with Tenant's access to the Premises. Except when and where Tenant's right of access is specifically excluded in this Lease, Tenant shall have the right of access to the Building and the parking facilities twenty-four (24) hours per day, seven (7) days per week during the Lease Term.   • apartment building means a residential use building, or the residential use portion of a mixed-use building, other than a townhouse or stacked townhouse containing four or more dwelling units each of which shall have access to above grade common halls, stairs, elevators, and yards;

  • residential premises means a house, building, structure, shelter, or mobile home, or portion thereof, used as a dwelling, home, residence, or living place by 1 or more human beings. “Residential premises” includes an apartment unit, a boardinghouse, a rooming house, a mobile home, a mobile home space, and a single or multiple family dwelling, but does not include a hotel, a motel, motor home, or other tourist accommodation, when used as a temporary accommodation for guests or tourists, or premises used as the principal place of residence of the owner and rented occasionally during temporary absences including vacation or sabbatical leave.

  • mixed-use building means a building or structure containing a residential and non- residential use other than a home occupation;
