Request for a Panel. 1. Unless the Parties agree on a different period for consultations, a complaining Party may request in writing the establishment of a Panel if the consultation referred to in the Article 176 (Consultations) fails to resolve a matter within 60 days, after the date of receipt of the request for consultations or 50 days in case of urgent matters.
2. The complaining Party shall deliver the request to the other Party, indicating at least, the reason of the request, the identification of the measure, an indication of the provision of this Agreement that it considers relevant and an indication of the legal basis of the complaint. The Panel will be considered as established on the date of receipt of the corresponding request to the other Party.
3. Unless otherwise agreed by the disputing Parties, the Panel shall be selected and perform its functions in a manner consistent with the provisions of this Chapter.
Request for a Panel. 1. A consulting Party may request in writing the establishment of a panel:
(a) if the requested Party has not responded to the request for consultations within 15 days of the date of receipt of such request;
(b) if consultations are not held within the periods established in Article 12.5 (Consultations) or within any other periods as the requested and requesting Parties may have agreed; or
(c) in the event that the consulting Parties fail to resolve a matter within 60 days of the date of the receipt of the request for consultations or as regards urgent matters within 45 days, or within any other period as they may agree.
2. The complaining Party shall deliver the request for the establishment of a panel to the Party complained against. The request shall contain the reason for the request, the identification of the specific measures, and a brief summary of the legal basis of the complaint sufficient to present the problem clearly.
3. A copy of the request shall be communicated to the other Parties.
4. Unless otherwise agreed by the disputing Parties, the panel shall be selected and perform its functions in a manner consistent with the provisions of this Chapter and the Model Rules of Procedure.

Upon expiry of the consultation period, or the period for the intervention of the Joint Commission, if such intervention has been requested, or any other period agreed by the Parties, the complaining Party may request in writing the establishment of a panel to consider the matter.
2. The complaining Party shall deliver the request to the other Party and set out in the request the reasons for the request, including identification of the measure or other matter at issue and an indication of the legal and factual basis for the complaint.
3. Unless otherwise agreed by the Parties, the panel shall be selected and perform its functions in a manner consistent with this Chapter, including Annex 23A.
4. A panel may not be established to review a proposed measure.

Where the Parties have failed to resolve the dispute in accordance with Article 17.4 (Consultations), the complaining Party may send a written request to the other Party for the establishment of a Panel to consider the matter. The request shall include an identification of the measure or other matter at issue and the provisions of this Agreement considered pertinent, as well as any other relevant circumstances.
