Remediation Period definition

Remediation Period has the meaning specified in Section 8.2(a);
Remediation Period means the time period between the first occurrence of the Remediation Event and the resolution of such Remediation Event which period may not exceed a total of ninety (90) days unless extended pursuant to Section 12.4.

Examples of Remediation Period in a sentence

  • If a Serious Incident has occurred and is ongoing, Seller shall not deliver and Buyer will not accept, Product from the Facility during the Remediation Period until such Serious Incident is remediated in accordance with this Section 6.4.

  • The Commercial Operation Date shall not occur during a Remediation Period.

  • If Seller provides Notice to Buyer, in compliance with Section 10.3, demonstrating to Buyer’s satisfaction that a Serious Incident is a Force Majeure Event, and that Seller’s ability to remediate the Serious Incident is prevented by the Force Majeure Event, then the Remediation Period shall be extended on a day-for-day basis until Seller is no longer prevented from remediating the Serious Incident by the Force Majeure Event.

  • Seller’s failure to remediate a Serious Incident within the Remediation Period, other than due to the occurrence of a Force Majeure Event, is a material breach of this Agreement; provided that that Seller may request to extend the Remediation Period by up to ninety (90) days and Buyer shall not unreasonably withhold approval of such extension.

  • Seller shall remediate any Serious Incident within the Remediation Period.


More Definitions of Remediation Period

Remediation Period means thirty (30) Business Days from the date upon which Homes England serves notice on the Lead Partner pursuant to Clause 25.7 (Default Events and Termination);
