Examples of Releasing Defendant Persons in a sentence
Consistent with such intention, upon Final Approval of the Settlement, the Releasing Persons and the Releasing Defendant Persons shall waive and relinquish, to the fullest extent permitted by law, the provisions, rights, and benefits of any state, federal, or foreign law or principle of common law, which may have the effect of limiting the respective Settled Claims and Released Defendant Claims.
The obligations incurred pursuant to this Stipulation shall be in full and final dismissal, discharge, settlement and disposition, with prejudice, of: (a) the Delaware Consolidated Action; (b) any and all Released Plaintiff Claims as against the Released Defendant Persons by any of the Releasing Plaintiff Persons; and (c) any and all Released Defendant Claims as against the Released Plaintiff Persons by any of the Releasing Defendant Persons.
The Settlement is intended to extinguish all of the Settled Plaintiff Claims and Settled Defendant Claims and, consistent with such intention, upon the Effective Date of the Settlement, the Releasing Plaintiff Persons and Releasing Defendant Persons shall waive and relinquish, to the fullest extent permitted by law, the provisions, rights, and benefits of any state, federal, or foreign law or principle of common law, which may have the effect of limiting the release set forth above.
All Releasing Defendant Persons (defined in paragraph 10 below) and anyone claiming through or on behalf of any of them in their capacities as such, are hereby permanently barred and enjoined from instituting, commencing or prosecuting, either directly or in any other capacity, any of the Released Defendant Claims (defined in paragraph 10 below) against any of the Released Plaintiff Persons (defined in paragraph 10 below), except in connection with any proceeding to enforce the terms of the Settlement.
In the Ally, First Horizon, SocGen, and Related Actions, the Releasing Defendant Persons shall, subject to all assertions of privilege, work product, and relevance, and conditioned upon compliance with reasonable confidentiality provisions, use all reasonable efforts to comply with any subpoenas pursuant to Rule 45 of the Federal Rules of Civil Procedure served upon them by any of the Released Plaintiff Persons relating to claims as to the Non-Settling Defendants.
