Notification of this selection must be made in writing at the time that both procedures have been invoked, and must be served on the Board, the appropriate Regional Director and all parties to both the un- fair labor practice case and the nego- tiability case.
If the Regional Director deter- mines that the charge has not been timely filed, that the charge fails to state an unfair labor practice, or for other appropriate reasons, the Re- gional Director may request the charg- ing party to withdraw the charge, and in the absence of such withdrawal within a reasonable time, decline to issue a complaint.
