Rail Operator has the meaning given in the Access Undertaking. Review Event has the meaning given to it in the Access Undertaking. Ship means the delivery of Coal to the Terminal by rail and the arrangement of vessels by the User such that DBIM is able to Handle the User's Annual Contract Tonnage.

Rail Operator means a person employed by RAIL on a continuing basis who receives an eight-hour minimum guarantee of straight-time pay per day, not to exceed five days per week, or a ten- hour minimum guarantee of straight-time pay per day not to exceed four days per week, provided s/he has accepted all work assigned as specified in the remainder of this Article. For each regularly-scheduled workday or portion thereof on which a Rail Operator does not perform his/her assignment, s/he shall lose his/her guarantee for that day and s/he shall be paid only for actual time worked, unless otherwise provided in this AGREEMENT. A “regularly-scheduled workday” shall mean a day on which an Employee is normally required to work.

• A similar arrangement will exist for Rail Operators for whom no Rail Operator position is available.

• In such cases, the Bus Operator will remain in his or her current position on the Extra Board until he or she is transferred to the Rail Operator position, per section 10-7.3A.

• The Port may elect, in its sole discretion, to accept or reject any comments that the Rail Operator may provide on such documents or agreements, and the Port assumes no obligation to request or require any applicable third party to accept or incorporate any comments of the Rail Operator.

"RailCorp" means Rail Corporation New South Wales constituted under this Act. "railway service" means a railway passenger service and a metro passenger service. "Residual Transport Corporation" or "RTC" means Residual Transport Corporation of New South Wales constituted under this Act. "Roads and Maritime Services" (or "RMS" ) means Roads and Maritime Services constituted under this Act. "rolling stock" means any vehicle that operates on or uses a railway track, but does not include a vehicle designed to operate both on and off a railway track or tracks when the vehicle is not operating on a railway track or tracks. "SOC conversion day" means the date of commencement of Schedule 2.1 [6] to the Transport Administration Amendment (Transport Entities) Act 2017 . "State Rail Authority Residual Holding Corporation" (or "SRA Residual Holding Corporation" ) means the State Rail Authority Residual Holding Corporation constituted under this Act. "State Transit Authority" means the State Transit Authority of New South Wales constituted under this Act. "Sydney Ferries" means Sydney Ferries constituted under this Act. "Sydney ferry services" means ferry services provided in Sydney Harbour or the Parramatta River. "Sydney Metro" means Sydney Metro constituted under this Act. "Sydney Metro Board" means the board of directors of Sydney Metro. "Sydney Trains" means Sydney Trains constituted under this Act. "transport assets" means assets used for or in connection with or to facilitate the movement of persons and freight by road, rail, sea, air or other mode of transport, and includes transport infrastructure. "transport district" means a transport district for the time being established under section 108. "Transport for NSW" (or "TfNSW" ) means Transport for NSW constituted under this Act. "transport infrastructure" means infrastructure used for or in connection with or to facilitate the movement of persons and freight by road, rail, sea, air or other mode of transport, and includes:
