Québec Settlement Class definition

Québec Settlement Class means the settlement class in respect of the Québec Action that is defined in Schedule “A” to this Settlement Agreement.
Québec Settlement Class means all Persons residing in Québec who raise cattle or who sell their cattle and who suffered damages due to the discovery of a case of bovine spongiform encephalopathy (“BSE”) in a cow, confirmed on May 20, 2003, in the province of Alberta, and who were affected by the closure of the border to beef and live cattle exports from Canada.

  • Notwithstanding subsections 6.1(1) and 6.1(2), members of the Québec Settlement Class who wish to opt-out may also do so by informing the clerk of the Québec Court on or before the Opt-Out Deadline.

  • All Persons in Canada who purchased Film Capacitors or a product containing a Film Capacitor during the Class Period other than (1) all BC Settlement Class members and (2) all Québec Settlement Class members.

  • Québec Settlement Class Members are given an opportunity to opt out of each new settlement reached in the litigation (but are not permitted to opt back into the Québec Proceeding once they have opted out).

  • Issues related to the administration of this Settlement Agreement, the Trust Account, and other matters not specifically related to the claim of a Québec Settlement Class member in the Québec Action or a BC Settlement Class member in the BC Action shall be determined by the Ontario Court.

  • Each Other Action commenced in Québec by a member of the Québec Settlement Class who makes a claim under this Settlement Agreement shall be dismissed as against the Releasees, without costs and without reservation.

Related to Québec Settlement Class

  • Ontario Settlement Class means the settlement class in respect of the Ontario Action as defined in Schedule A.

  • Settlement Class means, in respect of each Proceeding, the settlement class defined in Schedule A.

  • Settlement Classes means the following:

  • Settlement Class Period means the period January 1, 2006 through January 31,

  • PJM Settlement or “PJM Settlement, Inc.” shall mean PJM Settlement, Inc. (or its successor), established by PJM as set forth in Section 3.3 of the Operating Agreement.

  • ASX Settlement means ASX Settlement Pty Ltd (ABN 49 008 504 532);

  • Settlement Class Members means a Person(s) who falls within the definition of the Settlement Class.

  • Settlement Class Counsel means Xxxx X. Xxxxx and Xxxxxx X. Xxxxxx of Xxxxxxxxx Xxxxxx & Xxxxx XXX, Xxxx X. Xxxxx of The Rhine Law Firm, P.C., and Xxxx Xxxxxxxxx of Xxxxxxxxx & Xxxxxx P.A.

  • Viatical settlement broker means a person, including a life insurance producer as provided for in section 508E.3, who, working exclusively on behalf of a viator and for a fee, commission, or other valuable consideration, offers or attempts to negotiate viatical settlement contracts between a viator and one or more viatical settlement providers or one or more viatical settlement brokers. Notwithstanding the manner in which the viatical settlement broker is compensated, a viatical settlement broker is deemed to represent only the viator, and not the insurer or the viatical settlement provider, and owes a fiduciary duty to the viator to act according to the viator’s instructions and in the best interest of the viator. “Viatical settlement broker” does not include an attorney, certified public accountant, or a financial planner accredited by a nationally recognized accreditation agency who is retained to represent the viator and whose compensation is not paid directly or indirectly by the viatical settlement provider or purchaser.

  • Settlement Class Member means a member of a Settlement Class.

  • Final Settlement means permanent settlement of the Contractor’s actual allowable costs or expenditures as determined at the time of audit, which shall be completed within three years of the date the year-end cost settlement report was accepted for interim settlement by the State. If the audit is not completed within three years, the interim settlement shall be considered as the final settlement.

  • Net Settlement Amount means the Gross Settlement Amount, less the following payments in the amounts approved by the Court: Individual PAGA Payments, the LWDA PAGA Payment, Class Representative Service Payment, Class Counsel Fees Payment, Class Counsel Litigation Expenses Payment, and the Administration Expenses Payment. The remainder is to be paid to Participating Class Members as Individual Class Payments.

  • Gross Settlement Amount means Two Hundred Forty Thousand Dollars and Zero Cents ($240,000.00) which is the total amount Defendant agrees to pay under the Settlement. The Gross Settlement Amount will be used to pay Individual Settlement Payments, Individual PAGA Payments, the LWDA PAGA Payment, Class Counsel Fees Payment, Class Counsel Litigation Expenses Payment, Class Representative Service Payment, and the Administration Expenses.

  • Final Settlement Date has the meaning set forth in Section 2.4(c).

  • Physical Settlement Amount For any Settlement Date for which Physical Settlement is applicable, an amount in cash equal to the product of (a) the Forward Price in effect on the relevant Settlement Date multiplied by (b) the Settlement Shares for such Settlement Date.

  • securities settlement system means a securities settlement system (as defined in the CSD Regulation) operated by a central securities depository;

  • Maximum Settlement Amount means $500,000,000 as amended or modified in accordance with Appendix E.

  • Gross Settlement Fund means the Settlement Amount plus all interest earned thereon.

  • Individual Settlement Payment means the amount payable from the Net

  • Retail Settlement Code means the code approved by the Board which, among other things, establishes a distributor’s obligations and responsibilities associated with financial settlement among retailers and consumers and provides for tracking and facilitating consumer transfers among competitive retailers;

  • Net Share Settlement Amount: For any Settlement Date, an amount equal to the product of (i) the number of Warrants exercised or deemed exercised on the relevant Exercise Date, (ii) the Strike Price Differential for the relevant Valuation Date and (iii) the Warrant Entitlement.

  • Day-ahead Settlement Interval means the interval used by settlements, which shall be every one clock hour. Day-ahead System Energy Price:

  • Viatical settlement provider means a person, other than a viator, who enters into or effectuates a viatical settlement contract. Viatical settlement provider does not include:

  • Relevant Settlement Method In respect of any Option:

  • Net Share Settlement Amount For any Settlement Date, an amount equal to the product of (i) the number of Warrants exercised or deemed exercised on the relevant Exercise Date, (ii) the Strike Price Differential for the relevant Valuation Date and (iii) the Warrant Entitlement.

  • Purchase Contract Settlement Fund has the meaning specified in Section 5.5.
