Qualified Environmental Consultant definition

Qualified Environmental Consultant. An Independent Person, with at least five years of relevant experience, who regularly conducts environmental audits for purchasers of commercial properties located in the same general area as the Mortgaged Property.
Qualified Environmental Consultant means an environmental consultant which is qualified and recognized as such in the geographic area in which the related property is located.
Qualified Environmental Consultant means an environmental consultant selected by the Issuer (i) having all licenses, registrations and/or certifications required to act as such in the jurisdiction in which the relevant Mortgaged Property is located and (ii) reasonably acceptable to Servicer.

  • Environmental Condition means any condition or circumstance, including the presence of Hazardous Substances which does or would (i) require assessment, investigation, abatement, correction, removal or remediation under any Environmental Law, (ii) give rise to any civil or criminal Liability under any Environmental Law, (iii) create or constitute a public or private nuisance or (iv) constitute a violation of or non-compliance with any Environmental Law.
