Punchlist Work definition

Punchlist Work means and be deemed to refer to a list of Work compiled at the time of the Realized Date of Substantial Completion that is composed of incomplete or otherwise Defective Work that is of a such a minor nature and magnitude that it can, with respect to each item, be completed without disruption of UGAA’s ongoing operations or use of the subject structure and/or site and that it can be completed within thirty days of the Realized Date of Substantial Completion. Incomplete or Defective Work that is more-than-minor in nature or magnitude (i.e., which does not satisfy this definition) cannot be deemed mere Punchlist Work – and its existence will, at the election of UGAA, preclude realization of “Substantial Completion.”
Punchlist Work means all incomplete minor elements of the Work identified in accordance with this Agreement following Substantial Completion, which, in accordance with Prudent Industry Practices, are not required for the commercial operation of the Project or for any approvals from Governmental Authorities.
Punchlist Work means any item of Work that: (a) Client reasonably identifies or EPC Contractor identifies at the time of Substantial Completion as defective or requiring completion;

Examples of Punchlist Work in a sentence

  • In the event Owner elects to complete such Punchlist Work, Contractor shall pay Owner, within ten (10) Days after receipt of written notice from Owner, all reasonable costs and expenses incurred by Owner in performing such Punchlist Work, or, at Owner’s sole discretion, Owner may withhold or offset amounts owed to Contractor or collect on the Letter of Credit in accordance with Section 7.8 in the amount of such costs and expenses.

  • All Work on the Punchlist shall be completed by the date required for Final Completion, as specified in Section 5.3C, or Owner may, in addition to any other rights that it may have under this Agreement, complete such Punchlist Work at the expense of Contractor.

  • Upon Contractor’s request, Owner shall provide documentation identifying the costs and expenses to complete such Punchlist Work.

  • The Superintendent shall remain on-site daily until full completion of the entire Work, including Punchlist Work.

  • The obligation of Seller to complete the Punchlist Work is absolute and unconditional.

  • Design-Builder shall promptly (but in no case longer than thirty days after the Realized Date of Substantial Completion) complete all Punchlist Work and give notice thereof to the ADR.

  • Upon Contractor’s request, Owner shall provide documentation identifying the costs incurred to perform such Punchlist Work.

  • Contractor shall, at its own expense, complete all Punchlist Work (including all corrections or replacements) and test, inspect, re-test, or re-inspect, as appropriate, any portions of the Work so completed or corrected.

  • If Owner incurs any costs for the completion of such Punchlist Work in excess of the GMP, Contractor shall immediately pay Owner (directly, by offset, or by collection on the Letter of Credit, at Owner’s sole discretion), all reasonable costs and expenses incurred by Owner in excess of the GMP in performing such Punchlist Work.

  • In the event Buyer elects to terminate the Punchlist Escrow pursuant to the foregoing sentence, Seller shall no longer be obligated to complete any remaining portion of the Approved Punchlist Work.


More Definitions of Punchlist Work

Punchlist Work means all incomplete minor elements of the Work identified in accordance with this Agreement following Substantial Completion and as agreed between the Parties.
Punchlist Work is defined as minor or insubstantial incomplete work or details or defects of construction, decoration or mechanical adjustments that do not significantly affect Tenant’s use of Premises A or Premises B, as applicable, for the Permitted Use (without taking into effect Tenant’s specific manner of use). If any of the Tenant Improvement Work with respect to Premises A or Premises B, as applicable, remains to be completed which is more substantial than Punchlist Work then Substantial Completion of the applicable Tenant Improvement Work shall not have occurred until nothing but Punchlist Work remains and the parties shall continue to perform inspections until Substantial Completion of the applicable Tenant Improvement Work is confirmed. Notwithstanding anything herein to the contrary, receipt of a temporary Certificate of Occupancy from the City shall be conclusive evidence of Substantial Completion of the applicable Tenant Improvement Work. Landlord shall use commercially reasonable efforts to complete any Punchlist Work not fully completed (of which Tenant shall give Landlord notice as provided above) on the Term Commencement Date or Premises B Commencement Date, as applicable, within thirty (30) days of the later of (1) the Substantial Completion Date or Premises B Substantial Completion Date, as applicable, or (2) completion of the Punchlist (subject to Force Majeure and Tenant Delays) and Landlord shall have reasonable access to the Premises in accordance with the provisions of this Lease to complete the Punchlist Work. Except with respect to (x) the items contained in the Punchlist for Premises A and (y) the Premises B Work, as of the Substantial Completion Date Tenant shall be conclusively deemed to have agreed that Landlord has performed all of its obligations under this Article 4. Except with respect to the items contained in the Punchlist for Premises B, as of the Premises B Substantial Completion Date Tenant shall be conclusively deemed to have agreed that Landlord has performed all of its obligations under this Article 4.
Punchlist Work means items commonly known as punchlist items which (1) do not materially interfere with the use and occupancy of the Project, and (2) are reasonably expected to be completed within thirty (30) calendar days or such longer reasonable period of time as is acceptable to Buyer.
