Property Condition Reports definition

Property Condition Reports has the meaning set forth in Section 2.06.

Property Condition Reports have the meanings set forth in Section 3.1(S).

Property Condition Reports means those certain property condition reports for the Properties as described on EXHIBIT J.

Examples of Property Condition Reports in a sentence

• Except as set forth in the Environmental Reports (as such term is defined in the Disclosure Agreement), or the Property Condition Reports (as such term is defined in the (Disclosure Agreement), or as otherwise set forth in the Disclosure Agreement, the Property is in good condition and repair and is free from any damage that would materially and adversely affect the value of the Property as security for the Loan or the intended use of the Property.

• To the Borrowers' Knowledge after due inquiry, and except as disclosed in the Property Condition Reports, any septic system located at any of the Properties is in good and safe condition and repair and in compliance with all applicable law.

• In addition, the Borrower acknowledges receipt of the Environmental Reports and the Property Condition Reports and agrees to address in its prudent business judgment the recommendations contained in such reports.

• Property Condition Reports for each parcel of Real Property on which each Facility is located, the form, substance and results of which shall be satisfactory to Lender in its sole and absolute determination, unless waived in writing by Lender.

• To each Borrower's Knowledge, except as set forth in the Property Condition Reports for the Properties delivered to Lender, all Improvements including, without limitation, the roof and all structural components, plumbing systems, HVAC systems, fire protection systems, electrical systems, equipment, elevators, exterior doors, parking facilities, sidewalks and landscaping are in good condition and repair.

More Definitions of Property Condition Reports

Property Condition Reports collectively, those certain reports and assessments for each Property set forth on Schedule 6.17(A) attached hereto.

Property Condition Reports means those certain property condition surveys prepared by EMG and dated (i) June 11, 1997, with respect to the Forest Property, (ii) June 19, 1997, with respect to the Meadowbrook Property, (iii) June 12, 1997, with respect to the Branhaven Property, and (iv) June 13, 1997, with respect to the Hialeah Properties.

Property Condition Reports means collectively, those certain Property Condition Reports prepared by EMG for the Projects and delivered to Agent prior to the Closing.

Property Condition Reports collectively, the Property Condition Assessment Reports for the Properties described on Schedule 8. RELEASE AMOUNT: 85% of the Net Proceeds for such Property or Properties. RENTS: all rents, rent equivalents, moneys payable as damages or in lieu of rent or rent equivalents, royalties (including all oil and gas or other mineral royalties and bonuses), income, fees, receivables, receipts, revenues, deposits (including security, utility and other deposits), accounts, cash, issues, profits, charges for services rendered, and other payment and consideration of whatever form or nature received by or paid to or for the account of or benefit of a Borrower, Manager or any of their agents or employees from any and all sources arising from or attributable to the Properties and the Improvements, including all receivables, customer obligations, installment payment obligations and other obligations now existing or hereafter arising or created out of the sale, lease, sublease, license, concession or other grant of the right of the use and occupancy of the Properties or rendering of services by a Borrower or Manager and proceeds, if any, from business interruption or other loss of income insurance.

Property Condition Reports means, collectively the property condition reports prepared in respect of the Acquisition Properties as described in the Prospectuses;

Property Condition Reports means (i) all material capital needs assessments, capital improvement plans, operation and maintenance plans, engineering reports and other assessments or evaluations regarding the physical condition of the Parcels; and (ii) any material budgets or expense plans, projections or analyses addressing the cost of remediation, renovation or extraordinary maintenance to or on the Parcels, in either case, to the extent the same are, to the Knowledge of the Company, in the possession or control of the Company or any Company Subsidiary.

Property Condition Reports means, collectively, Property Evaluation Report prepared by Claris Services dated August 4, 1994; Monroe & Xxxxxx engineering report dated May 22, 2001; Encompass engineering report dated May 17, 2001; Xxxx X. XxXxxxxx engineering report dated May 16, 2001; Encompass engineering report dated July 3, 2001; Xxxx Xxxxxx Consulting Services report dated June 12, 2001; Riviera Electric report dated April 15, 1998; Xxxxxxxx Mechanical report dated April 15, 1998; Koechlein Consulting Engineers Soils Test Report; and, Elevator Inspection Certificates Expiring 10/31/05.
