Proof of Adherence to the Vehicle’s Maintenance Schedule” “Proof of Adherence to the Vehicle’s Maintenance Schedule” shall mean submission of documents and records evidencing the Settlement Class Member’s adherence to those aspects of the Settlement Class Vehicle’s maintenance schedule set forth in the Warranty and Maintenance Booklet that are applicable to the vehicle’s tires, including rotation of the tires every 10,000 miles of tire use, during the time he/she/it owned and/or leased the vehicle up to the date/mileage of tire replacement, within a variance of five percent (5%) of the scheduled mileage tire rotation requirements. In the event the Settlement Class Member is unable to obtain maintenance documents and records despite having undertaken a good faith effort to obtain them, the Settlement Class Member may submit a Declaration under penalty of perjury detailing what efforts were made to obtain the records and attesting to adherence to the vehicle maintenance schedule, up to the date/mileage of tire replacement, within the five percent (5%) variance set forth above. Disputes as to the sufficiency of said documentation or declaration shall be submitted to and resolved by the Claims Administrator agreed to by the parties. In the event the Claims Administrator makes a preliminary determination that the proof or declaration submitted in support of the claim is deficient, the Claims Administrator will send the Settlement Class Member a letter advising of the deficiencies. The Settlement Class Member will have forty-five (45) days from the date of the Claim Administrator’s letter to cure the deficiencies or the claim will be rejected. This provision does not apply to claims that, based on the proof submitted, do not qualify for reimbursement benefits under the terms of the Settlement.
Proof of Adherence to the Vehicle’s Maintenance Schedule” shall mean documents evidencing the Settlement Class Member’s adherence to the relevant aspects of their Eligible Vehicle’s maintenance schedule, set forth in the Warranty and Maintenance Booklet for the vehicle that are relevant to the coolant system, including use of the specification of coolant fluid recommended by Volkswagen [for the Volkswagen Eligible Vehicles] and Audi [for the Audi Eligible Vehicles], during the time he/she/it owned and/or leased the vehicle, up to the date/mileage of repair or replacement, within a variance of ten percent (10%) of the scheduled time/mileage requirements. In the event maintenance records cannot be obtained despite a good faith effort to obtain them, the Settlement Class Member may submit a sworn Declaration detailing what efforts were made to obtain the records, including the person(s) with whom he/she/it communicated in an effort to obtain the records, when and in what manner that occurred, and why the records are not available, and attesting to adherence to the Eligible Vehicle’s maintenance schedule as set forth above. In the event the Claims Administrator makes a preliminary determination that the proof submitted is insufficient, the Claims Administrator shall send the Settlement Class Member a letter advising of the deficiencies. The Settlement Class Member shall have thirty (30) days after receipt of the letter to cure the deficiencies or the claim shall be rejected, unless the Settlement Class Member requests to dispute the decision within thirty (30) days after receiving the rejection letter. Upon such request, Class Counsel and VW shall meet and confer to resolve the disputed claims.
Proof of Adherence to the Vehicle’s Maintenance Schedule” “Proof of Adherence to the Vehicle’s Maintenance Schedule” shall mean documents or records evidencing the Settlement Class Member’s adherence to those aspects of the Settlement Class Vehicle’s maintenance schedule set forth in the Warranty and Maintenance Booklet that are directly relevant to the coolant system, including use of the specification of coolant fluid recommended by VW [for the VW Settlement Class Vehicles] and Audi [for the Audi Settlement Class Vehicles], during the time he/she/it owned and/or leased the vehicle up to the date/mileage of repair or replacement, within a variance of ten percent (10%) of each scheduled time/mileage interval. If, however, the Settlement Class Member is unable to obtain said documents or records despite a good faith effort to obtain them, the Settlement Class Member may submit a Declaration, signed under penalty of perjury, detailing: (i) the good faith efforts that were made to obtain the records including the person(s) with whom he/she/it communicated in an effort to obtain the records, when and in what manner that occurred, and why the records are not available, and (ii) attesting to adherence to the vehicle maintenance schedule relevant to the coolant system during the time he/she/it owned or leased the vehicle, up to the date/mileage of replacement/repair, within the ten percent (10%) variance set forth above.

Examples of Proof of Adherence in a sentence

  • As to all Settlement Class Vehicles, the Warranty Extension is conditioned upon the Settlement Class Member providing, to the dealer, Proof of Adherence to Maintenance Requirements.

  • Keep a copy of the completed Claim Form for your records; and(2) Mail the Claim Form and your supporting documentation, such as repair record(s), receipts, proof of payment, and Proof of Adherence to the Vehicle's Maintenance Schedule by first class mail postmarked no later than April 30, 2020 to the address on the Claim Form.

  • When you bring the vehicle to an authorized Audi dealer for an Extended Warranty repair or replacement, you must also bring to the dealer Proof of Adherence to the Vehicle's Maintenance Schedule.

  • In addition to properly completing the Claims Form, Class Members must only provide Proof of Tire Replacement Expense(s), Proof of Adherence to the Vehicle’s Maintenance Schedule,6 and, inter alia, an affirmation that the Class Member has not been previously reimbursed for the expenses for which reimbursement is sought on the Claims Form.

  • Any reimbursement under this Section is conditioned upon timely presentation of a fully completed, signed and dated Claim Form together with the required Proof of Repair Expense and Proof of Adherence to the Vehicle’s Maintenance Schedule documentation.

  • Any inquiry on that order must identify the pharmacist who verified it.

  • Online:(1) Complete and submit an online Claim Form and upload supporting documentation, such as repair record(s), receipts, proof of payment and Proof of Adherence to the Vehicle's Maintenance Schedule, via the portal contained on the Settlement website, www.EngineWaterPumpSettlement.com, no later than April 30, 2020.

  • When you bring the vehicle to an authorized VW dealer for an Extended Warranty repair or replacement, you must also bring to the dealer Proof of Adherence to the Vehicle's Maintenance Schedule.

  • In order to submit a valid and timely Claim for Reimbursement pursuant to Section II.B. of this Agreement, the Settlement Class Member must mail to the Settlement Claim Administrator, post-marked within the Claim Period (no later than 75-days after the Notice Date), a fully completed, signed and dated Claim Form, together with the required Proof of Repair Expense, Proof of Adherence to Maintenance Requirements, and any other proof set forth in Section II.B. of this Agreement.

  • Mail the Claim Form and your supporting documentation, such as repair record(s), receipts, proof of payment, and Proof of Adherence to the Vehicle's Maintenance Schedule by first class mail postmarked no later than April 30, 2020 to the address on the Claim Form.

Related to Proof of Adherence

  • Deed of Adherence means a deed of adherence substantially in the form set out in schedule 9;

  • Proof of Claim means a proof of Claim Filed against any of the Debtors in the Chapter 11 Cases.

  • Proof of payment means, as applicable, a copy of the check, confirmation of credit card or debit card payment, confirmation of wire or ACH transfer, and any other information required to demonstrate that payment has been made according to the EPA requirements, in the amount due, and identified with the Respondent’s name and Docket No. FIFRA-04-2021-0714(b).

  • Proof of vaccination means documentation provided by a tribal, federal, state or local government, or a health care provider, that includes an individual’s name, date of birth, type of COVID-19 vaccination given, date or dates given, depending on whether it is a one-dose or two-dose vaccine, and the name/location of the health care provider or site where the vaccine was administered. Documentation may include but is not limited to a COVID-19 vaccination record card or a copy or digital picture of the vaccination record card, or a print-out from the Oregon Health Authority’s immunization registry.

  • Proof of Loss means satisfactory written proof that a loss occurred for which the Group Policy provides benefits, which is not subject to any exclusion, and which meets all other conditions for benefits. Proof of Loss includes any other information We may reasonably require in support of a claim for benefits under the Group Policy.

  • Complainant means an individual who is alleged to be the victim of conduct that could constitute sexual harassment.

  • Proof of address/business address means a document less than 3 months old containing residential address that is a utility bill, bank statement, rates account or tax invoice.

  • Out-of-service order means a temporary prohibition against driving a commercial motor vehicle.

  • Proof of financial responsibility means proof of ability to respond in damages for liability, on account of accidents occurring after the effective date of the proof, arising out of the ownership, maintenance, or use of a motor vehicle, in the amount of twenty-five thousand dollars because of bodily injury to or death of one person in any one accident, and, subject to the limit for one person, in the amount of fifty thousand dollars because of bodily injury to or death of two or more persons in any one accident, and in the amount of twenty-five thousand dollars because of injury to or destruction of property of others in any one accident.

  • Proof of Claim and Release means the Proof of Claim and Release form for submitting a Claim, which, subject to approval of the Court, shall be substantially in the form attached hereto as Exhibit A-2, that a Class Member must complete and submit should that Class Member seek to share in a distribution of the Net Settlement Fund.

  • Additional Performance Security means the Bank Guarantee to be submitted by Successful Bidder in accordance with Clause 8.7 of this RFP Document

  • Registered Plan means a registered retirement savings plan, a registered retirement income fund, a deferred profit sharing plan, a registered education savings plan, a registered disability savings plan, and a tax-free savings account.
