PROMOTION AND TRANSFER. 9:1 Employees may file requests, in writing, for promotion to the Working Xxxxxxx classification or for a Employees may file requests, in writing, for promotion to the Working Xxxxxxx classification or for a transfer to a new location in their present classification with the Office of the Company. Whenever a vacancy occurs, the Company will, before filling such vacancy, first give consideration to such requests and the following factors being sufficient give preference on the basis of seniority.

PROMOTION AND TRANSFER. 10.1 When new jobs or additional jobs are created, or vacancies other than temporary occur within the Agency, regardless of bargaining unit, which Agency intends to fill, the Agency shall post vacancy notices on all bulletin boards and a copy shall be mailed to the recognized employee organization. Vacancy notices shall be posted for a period of seven (7) calendar days and shall set forth the date of posting, the classification and location of the job, its duties, qualifications required and the rate of pay. Employees may submit bids on such vacancies by United States mail to the Office of the Agency and the Agency shall not consider any bids postmarked more than seven (7) calendar days from the date of posting.
PROMOTION AND TRANSFER. Promotions or transfers within the Bargaining Unit to higher paid jobs within a Skilled Trade shall be based on the qualifications necessary as a Journeyperson for such jobs. When these factors are equal, the employee with the greatest plant seniority will be given the preference.

PROMOTION AND TRANSFER. 11.1 Except as otherwise provided for in this section for the entry-level positions of Custodian, Utility Field Worker, Solid Waste Worker, Solid Waste Truck Driver I, Airport Maintenance Worker, Convention Center Maintenance Worker, Mechanic I, and Public Works Maintenance Worker when new positions, additional positions, or new shifts (i.e. days, swings, graveyards) within the same Division or Department are created, or vacancies other than temporary vacancies occur, in positions within the appropriate bargaining units for whom Local Union 1245 is the exclusive representative, the City shall fill such positions or shifts from qualified pre-bid employee applications, if any. In filling such positions or shifts, the City shall give preferential consideration to Regular employees as defined in 7.2, who are within the bargaining unit covered by this Memorandum of Understanding, in the sequence set forth below. When employees in the same preferential sequence as provided in (a) through (f) are each qualified by knowledge, skill, efficiency, adaptability and physical ability for appointment to the position vacancy, the pre-bid of the employee with the most City seniority in an IBEW Local Union 1245-Maintenance bargaining unit shall be given preferential consideration for appointment. When employees have the exact same seniority date, the tie will be broken by the initial application test score with greater seniority awarded to the employee with the higher test score. For the first and each subsequently odd-numbered entry-level position vacancy which occurs after July 15, 1984, in each of the divisions or departments as set forth in 11.4, the City will follow the procedures set forth as follows in filling each such entry-level position vacancy. Whenever any qualified bargaining unit employee hired before October 28, 1990 pre-bids the entry-level position vacancy, the City must select from among those bargaining unit employee pre-bidders. Whenever no qualified bargaining unit employee hired before October 28, 1990, pre-bids, the City may select any applicant to fill the entry-level position vacancy. For each even-numbered entry-level position vacancy which subsequently occurs, the City may refrain from following the procedures set forth above and may select any applicant for an entry-level position vacancy which in the judgment of the City is best qualified for said position vacancy.

Section 12.0 When vacancies occur in positions described in Exhibit "A," the City shall post notices of same on designated bulletin boards and a copy of such notices shall be mailed to the Union's Business Representative. Temporary hiring to fill any job classification within the bargaining unit shall neither require posting of notices of same nor mailing of such notices to the Union's Business Representative. Such notices shall be posted for a period of ten (10) calendar days (unless the tenth day is a non-workday, in which case, the closing date shall be the preceding workday) and shall set forth the position vacancy number, the date of posting, the classification, the location, the job definition, the rate of pay and the closing date for receipt of application. Any employee may apply to the City office for consideration in the filling of such vacancies, and the City shall consider any application received prior to 4:00 p.m., on the day specified in the notices for the closing of applications for such positions. In filling such positions, the will interview regular employees, who are within the bargaining unit who apply for such positions. For purposes of determining the most qualified candidate for the position, the City may utilize written tests, oral board examinations, background investigations, personal interviews, education, experience and seniority with the City as well as any other appropriate methods for evaluating candidates for employment. Where oral board examinations are used, bargaining unit employees may be utilized by the City to participate as observers or examiners as needed. In the event the City determines that written or oral tests or examinations are to be administered for any given position, the City shall, on the posted notice of the availability of a position covered by this section, specify that an oral and/or written test or examination shall be administered, if at all.
