Project Charge definition

Project Charge means a charge, mortgage and/or security interest in, to and over the Property as well as all hereafter acquired property rights pertaining to the Project and a charge, mortgage and/or security interest in, to and over all present and after acquired personal property used at or in connection with, or derived from the Project which shall be in form and substance satisfactory to Sandstorm acting as a prudent lender, as more particularly described in Article 19;
Project Charge means a charge over all of the assets, property and undertaking of Lordsburg in respect of the Project to secure all guarantee obligations of Lordsburg under this Agreement and, after the Waterton Repayment Date, includes the Additional Charges;
Project Charge means any Clause 17 Cross Charge given by the Company.

Project Charge means a valid and perfected charge, which Sandstorm and Sandstorm “...[agreement redacted – proprietary structure]” agree shall be subordinate to any other charge granted by SilverCrest or NMS for the purpose of securing Debt Financing, securing an interest in all of the Property comprising the Project, which shall be comparable to (and no less favourable than) the terms and conditions of the Creditor Project Charge (save and except with respect to the subordinated nature of the Project Charge);

  • Capacity Charge means a charge for public facilities in existence at the time a charge is imposed or charges for new public facilities to be acquired or constructed in the future that are of proportional benefit to the person or property being charged, including supply or capacity contracts for rights or entitlements, real property interests, and entitlements and other rights of the local agency involving capital expense relating to its use of existing or new public facilities. A “capacity charge” does not include a commodity charge.
